AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CIBOLO
TEXAS DECLARING AMENDMENTS TO THE CITY OF CIBOLO
HOME RULE CHARTER TO BE ADOPTED; AND PROVIDING FOR
RELATED MATTERS:
WHEREAS: On May 14, 2011 the City of Cibolo held an election on the adoption of
amendments to the City's Home Rule Charter to create single member districts; and
WHEREAS: At said election a majority of the votes cast for the adoption of said proposed
amendment was passed by a majority vote of those voting in said election; and
WHEREAS: Texas Local Government Code Section 9.05 (b) provides that an amendment to a
charter does not take effect until the governing body of the municipality enters an order in the
records of the municipality declaring that the amendment is adopted; and
WHEREAS: pursuant to notice of a public meeting held in compliance with the Texas Open
Meetings Act, the City Council of the City of Cibolo, Texas, convened into a regular meeting of
the City Council on this the 28th day of May, 2013 for the purpose of entering an order into the
records of the City and declaring that the amendments to the City Charter are adopted;
NOW THEREFOREBE IT ORDAINED BY THE CITY COUNCILOF THE CITY OF
CIBOLO,TEXAS:
Section 1.Findings.The foregoing recitals are hereby found to be true and correct and are
hereby adopted by the City Council and made a part hereof for all purposes as findings of fact.
Section 2:Proceedings.That an election was duly called on February 22, 2011 and final votes
were canvassed on May 19, 2011 on the question of the adoption of an amendment to the City
of Cibolo Home Rule Charter creating single member districts; and the following charter
sectionis hereby amended as follows based on the results of the election:
SECTION 3.01 Composition
(1) The "City Council" shall be composed of a "Mayor" and seven (7) "Council
Members" who shall-serve for a term of two (2) years and until their successor has
been elected and duly qualified.
(2) The City shall, by ordinance, be divided into seven (7) districts. Each district shall, to
the extent reasonably possible, be equally populated and the City Council shall
maintain such equality of population, as from time to time deemed necessary, by
ordinance. The districts shall be designated Number 1, 2, 3, 4, 5, 6 and 7. The
qualified voters of each district shall elect one (1) Council Member for each of the
seven(7) districts.
(3) The Mayor of the City shall beelected at large by the qualified voters of the City
and shall meet the qualifications provided for in this Charter.The "City Council" shall
be composed of a "Mayor" and five (5) "Council Members" elected under the Place
System, with there being Places 1, 2, 3, 1, and 5. The Mayor and each Council
Member shall be elected at large, and unless sooner removed under the provisions of
of passage of this Charter shall continue to hold their respective office until their
respective term of office for which they were elected expires. The Mayor and City
Council members may serve no more than three (3) consecutive terms and must "sit
out" for two years prior to being eligible to run for the same elected office, i.e. Mayor
or City Council Member. That is, a Council Member completing three consecutive
terms is eligible to run for Mayor, and a Mayor completing three consecutive terms is
eligible to run for City Council without a"sitting out"period.
(4) The terms of Council Members holding places 1, 4, & 5 shall expire in even-numbered
years. The terms of Council Members holding places 2 & 3 shall expire in odd-
numbered years. The Mayor shall be elected in an odd-numbered year.
(5) At such time as the City attains ten thousand (10,000) inhabitants as determined by the
laws of the State of Texas,the number of Council Members shall increase to seven(7).
The two additional Council Members shall be elected in accordance with the laws of
the State of Texas.
Section 3.Adoption.The amendments provided for herein are hereby declared adopted by the
City Council of the City of Cibolo and this ordinance shall be entered into the records of the City
of Cibolo as an order of adoption of the charter amendments.
Section 4. Open Meetings.It is hereby officially found and determined that the meeting at
which this resolution is passed was open to the public as required and that public notice of the
time,place, and purpose of said meeting was given as required by the Open Meetings Act,
Chapt. 551, Tex. Gov't. Code, having been posted and remaining posted continuously for at least
72 hours preceding the date of this meeting.
