ORD 1114 09/23/2014 OF CIO 0 r 0 R � f ORDINANCE # 1 1 14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS AMENDING THE UTILITY FEE SCHEDULE OF THE CITY-OF CIBOLO; PROVIDING FOR ADOPTION; THERETO;_ PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY NOT IN CONFLICT WITH THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR .SEVERABILITY; PROVIDING FOR SAVINGS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 78-64 of the City of Cibolo's Code of Ordinances establishes that rates, fees., deposits and charges for services. furnished by the city's utility department shall be established by ordinance or resolution of the city council, from time to time, and made available for public examination in the office of the city secretary; WHEREAS, the City of Cibolo contracted with McLain Decision Support.Systemsto update a utility rate study for the period 2014-2023; WHEREAS, the Cibolo Creek Municipal Authority has-increased wastewater service rates to the City of Cibolo by ten percent(10%) for:fiscal year 2014; WHEREAS, the City of Cibolo contracts. with Bexar Waste for garbage and recycling collection services and Bexar Waste has agreed to provide a number of large recycling containers, at their cost, for customers who request such; and contractor desires reparation for lost or stolen carts; WHEREAS, the City Council wishes to amend and/or clarify the utility fee schedule in accordance with the facts above; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO TEXAS: SECTION 1 That the above and foregoing premises-are true and correct and are incorporated herein and made'part hereof for all purposes-. - SECTION 2 ADOPTION That the City Council of.the City of Cibolo, Texas hereby establishes utility:rates and fees, as provided for in the Attached Exhibit"A". SECTION 3 CUMULATIVE CLAUSE That this Ordinance shall be cumulative of all other ordinances of the City of Cibolo; Texas, except where the provisions of this Ordinance are in direct conflict with the provisions of such other ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 4 SEVERABILITY That it is hereby declared to be the intention of the City Council of the City of Cibolo that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and-if any phrase, clause, sentence, paragraph or section of this Ordinance should be' declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of the Ordinances, since the same would have been enacted by the City Council without incorporation in .this ordinance of any such unconstitutional'phrases, clause, sentence,paragraph or section. SECTION 5 SAVINGS That all rights and privilege of the City of Cibolo are expressly saved as to any and all violations of the provision of any Ordinances affecting the utility rates, which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violation and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 6 EFFECTIVE DATE That this Ordinance shall be effective for the first billing--cycle following October 1St, 2014, upon the approval of the City Council of the City of Cibolo, Texas and after being twice published in the City's paper of.record.
