"City of Choice" ORDINANCE NO. 1.15 6 AN ORDINANCE OF THE CITY OF CIBOLO, TEXAS AMENDING SECTION 74-87 OF THE .CODE OF ORDINANCES AUTHORIZING THE INSTALLATION AND MAINTENANCE OF A NO PARKING ZONE ALONG PORTIONS OF ELDRIDGE DRIVE AND EGLINGTON WAY, PROVIDING EXCEPTIONS, PROVIDING FOR REPEALER AND EFFECTIVE DATE WHEREAS, the City of Cibolo seeks to protect the public safety, preserve the quality of life and prevent nuisances in the City; and WHEREAS, there is insufficient clearance between driveways to park a vehicle without impeding the use of adjacent driveways; and WHEREAS,the majority of the residents of the affected area have been polled and are in agreement with designation of this area as a"No Parking Zone". NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, THAT SECTION 74-87 OF THE CODE OF ORDINANCES BE AMENDED: Section 1. Sec. 74-87 Specific No Parking Areas: (a) It is unlawful for any person to park a motor vehicle within the cul-de-sac adjacent to 401,405, 409 Eldridge Drive and 302, 306 Eglington Way, Cibolo, Gualdalupe County, Texas. (b) It is a defense to prosecution under this section that the vehicle parked on the designated street at a prohibited time was parked: (1) for not more thana.0 minutes for the purpose of delivering or picking up merchandise or material from a residence located on the street where parking is prohibited; 200 South Main Street,P.O.Box 826,Cibolo,Texas 78108 Phone: 210-658-9900 Fax: 210-658-1687 (2) by an official, employee or agent of the federal, state, county or municipal government (collectively "operative"), and the governmental operative is on official government business; or (3) by an official, employee or agent of a public utility (collectively "operative"), franchised to operate in the City, and the public utility operative is addressing a service issue on the on the street where parking is prohibited; (c) Any person found in violation of this article shall be deemed guilty of a Class C misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed $200.00 and each day during which such violations continue shall constitute a separate and distinct offense. Section 2. The City shall erect No Parking signs in conformance with the Texas Transportation Commission's Manual on Uniform Traffic Control Devices on the aforementioned roadways. Section 3. Repealer: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4. Notice and Effective Date. The City Secretary shall publish notice of this ordinance in accordance with the requirements of City Charter Section 3.13(3) and this ordinance shall become effective upon compliance with said requirement or on the date the traffic control device is erected, whichever occurs later.
