Min CC 09/15/1977 MINUTES CIBOLO CITY COUNCIL CIBOLO, TEXAS SEPTEMBER 15, 1977 1 . CALL TO ORDER: John A. Sippel, Mayor 2. QUORUM CHECK: Linda N. Ling, City Secretary. All Council Members present . 3 . INVOCATION: Bill Wiederstein 4. MINUTES: A motion was made by Fred Niemietz(Marge Smith) and passed unanimously to approve the minutes of the last regular City Council meeting as presented. 5. CITIZENS TO BE HEARD: No citizens appeared before the Council at this meeting. 6. OLD BUSINESS: A. A motion was made by Fred Niemietz(Marge Smith) to approve the letter of intent to Cibolo Creek Municipal Authority and Resolution No . 1038 requesting the U. S. Army Corps of Engineers to provide a detailed project study of the Cibolo Creek from the M.K.T. Railroad to the Schaefer Road. All Approved. B. F.M. 78 - No discussion except that presentations were arrainged with neighboring communities. 7. NEW BUSINESS: A. A request was presented by Chief of Police Jeronimo Marin for an ordinance establishing a Police Reserve Force for the City of Cibolo . .Fred Niemietz (Sigfrid Swenson) made a motion for Ordinance No. 246 ' Establishing a Police Reserve Force and adopting the provisions of Article 998a, Vernon's Annotated Texas Statutes and setting forth the conditions concerning the establishing of such Police Reserve Force and its activities. All Approved. B. Planning and Zoning Committee and Board of Adjustment was discussed. A list of names is to be presented for Council approval. C. A motion was made by Bill Wiederstein(Marge Smith) and passed unanimously to accept the new water and sewer rates which is established by Ordinance No . .2 4 7 . D. Bills to be approved were read. A motion was made by Fred Niemietz Alllgippxd�ovednson) that all except the Tri City Insurance be paid at this time . E. A motion was made by Fred Niemietz (Sigfrid Swenson) that we .have completed our initial agreement with COMA for the 208 office at AACOG and ©ur.present budget cannot afford this expense for the coming year. LING QTY SECRETARY LETTER OF INTENT CITY OF CIBOLO The City Council of the City of Cibolo, State of Texas, after •I ' - consultation with representatives of the residents of the affected area of the Cibolo Creek vicinity and in accordance with your request of a letter of intent executed by this Council, state: That the City Council of the City of Cibolo would, when requested, if the City of Cibolo approves of the plan, furnish a resolution of assurance to sponsor the project and assure timely construction by complying with the provisions of Section 205 of the 1948 Flood Control Act as amended. These provisions are summarized and set forth below: 1. Provide without cost to the United States all lands, easements, and rights-of-way necessary for project construction. 2 . Bear the cost of all alternations and reloctions to utilities, roads, bridges, cemeteries, and other community services, except railroads . 3. Hold and save the United States free from damages due to construction, operation, and maintenance of the project, does not include damages due to the fault or negligence of the United States or its contractors. 4. Maintain and operate the project after completion in accordance with regulations prescribed by the Secre- tary of the Army. 5. Assume full responsibility for all project costs in excess of the Federal cost limitation. 6. Make cash contribution for project costs assigned to project features other than flood control. I ' 7 . Contribute toward construction costs where substantial land e hancement or similar type benefits will accrue in accordance with existing policies for regularly authorized projects . 8. Prevent encroachment which could interfere with proper functioning of the flood control. project. 9. Prevent encroachment on any ponding areas or, if ponding areas are impaired, provide a substitute storage capacity or equivalent pumping capacity --\ promptly without cost to the United States . 10. Agree to consider the adoption of such flood plain regulations necessary to insure compatibility between future development and the degree of flood protection provided in the project area. Dated this s day of ���T, , 197Z / l . Ma ATTEST: r' RESOLUTION RESOLUTION REQUESTING THE U.S. ARMY, OORPS OF ENGINEERS TO PROVIDE A DETAILED PROJECT STUDY OF THE CIBOLO CREEK FROM THE M.K.T. RAILROAD TO THE SCHAEFER ROAD. Whereas, there have been major floods along the Cibolo Creek causing heavy loss of municipal and private properties and whereas the area lying between the M.K.T. Railroad and the Schaefer Road area which em- braces the cities of Selma, Schertz, Universal City, and Cibolo receives the brunt of such flooding, and Whereas, the low alluvial ,plain of the Cibolo Creek lies within the boundaries of the cities of Selma, Schertz,/and Cibolo and whose families are subject to such flooding, and Whereas, there is strong indications that both man-made and natural obstructions may' impede or redirect the natural flow of water and may in fact, increase the severity of flooding. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOUJ, a� TEXAS, that: An immediate detailed project engineering study should be conducted by the U.S. Army Corps of Engineers on that portion of the Cibolo Creek lying between the M.K.T.- Railroad and the Schaefer Road area; that special emphasis be placed on physical flood control in and around the City of Cibolo.; that this requested study propose measures that can be taken to alleviate the severity of flooding, and provide a written report to the City of Cibolo of these findings .
