Call to Order-Meeting was called to order by Mayor Dunn at 6:33 pm. 2. Roll Call and Excused Absences—Members Present: Mayor Dunn, Councilwoman Schultes,Councilman Garrett, Councilwoman Gebhardt, Councilman Doty, Councilman Russell, Councilman Hogue and Councilman Weber; Staff Present: City Manager Herrera, City Attorney Erkan, City Secretary Cimics, Fire Chief Niemietz, Police Chief Cox, Finance Director Miranda, ED Director Luft, Planning and Engineering Director Klein,Public Works Director Fousse and City Planner Gonzalez. 3. Invocation—Invocation was given by Councilman Russell. 4. Pledge of Allegiance—All in attendance recited the Pledge of Allegiance. - - 5. Citizens to be Heard — This is the only time during the Council Meeting that a citizen can address the City Council. It is the opportunity for visitors and guests to address the City Council on any issue to include agenda items. All visitors wishing to speak must fill out a"Citizens to be Heard" Form prior to the start of the meeting. City Council may not debate any non-agenda issue, nor may any action be taken on any non-agenda issue at this time,however, City Council may present any factual response to items brought up by citizens. The following citizens signed up to be heard: Maggie Titterington from The Chamber showed a video of The Chamber with the new logo. Jessica Crawford introduced herself and informed the audience that she was running for the District Judge in the 25" District and would like everyone's support. Bob Hicks complimented the City Staff especially the Public Works and Utility Department. Mr. Hicks stated that the City has a good staff and a great team. Eugene Mayes spoke to council and stated that he was running for Constable in Precinct 4 and would like everyone's support and vote. Carol Buell gave an update on the Citizen's Barbecue Cook-off scheduled for January 29th and January 30th. Dan Cosner wanted to go on record that he supported the Borgfeld Manor Project. Mr. Cosner lives across the street from the project and feels that this type of project is needed in the City of Cibolo. 6. Public Hearings A. The Cibolo City Council will conduct a public hearing to hear public testimony concerning the proposed annexation of the properties described below: • All properties located in the City of Cibolo's Extraterritorial Jurisdiction(ETJ)generally located south of Schaffer Road, and west of Haeckerville Road containing 893 ±acres. 1 • All properties located in the City of Cibolo's Extraterritorial Jurisdiction(ETJ)generally located 800 feet northeast of the intersection of Cibolo Valley Drive and Green Valley Road, and containing 29facres. •All properties located in the City of Cibolo's Extraterritorial Jurisdiction(ETJ)generally located south of 1H 10 and west of Linne Street, and containing 45facres. Mayor Dunn called the Public Hearing to order at 6:50 pm. Ms. Gonzalez the City Planner briefed the item to council and those in attendance. Mr.Young who owns property in the Cibolo ETJ and is part of the proposed annexation requested an extension of his Annexation Agreement. His property is located approximately one mile from Haeckerville Road and the only access to his property is over a low water crossing over Cibolo Creek. There is no home on the property and he uses the property for hay. Mr.Young gave a letter to council on his request for an extension. Mr.Real spoke to council on the annexation of his property located on Lower Seguin Road. He does have a homestead, barn and storage sheds on the property. The land is used for agriculture and timber. Mr. Real would like an extension to his Annexation Agreement. Mr. Laubach spoke for his parents property located on Haeckerville Road. He had questions on burning trash and hunting on the property. No other citizens wish to speak and Mayor Dunn closed the Public Hearing at 7:28 pm. B. The Cibolo City Council will conduct a public hearing to hear public testimony concerning a request to allow a Conditional Use Permit on a 3.11 acre property zoned C-3 located on the east side of FM 3009 between Dietz Road and Deer Creek Boulevard for a Self-Storage facility. This Public Hearing was tabled and will be on the January 26, 2016 agenda.. _ 7. Resolution A. Approval/Disapproval of a resolution of the City of Cibolo supporting the proposed Borgfeld Manor affordable elderly housing development and providing an effective date. Councilman Garrett made the motion to approve the resolution of the City of Cibolo supporting the proposed Borgfeld Manor affordable elderly housing development and providing an effective date. Motion was seconded by Councilwoman Gebhardt. Councilman Doty requested a roll call vote. Councilwoman Schultes — Yes, Councilman Garrett — Yes, Councilwoman Gebhardt — Yes, Councilman Doty — Yes, Councilman Hogue—Yes, Councilman Russell—Yes,and Councilman Weber—Yes. Motion carried 7 to 0. 8. Presentations A. Presentation to receive artwork donated by John&Cynthia Nail of Cibolo,Texas. Mr. &Mrs.Nail were unable to attend the meeting. City Manager Herrera unveiled the art work donated by the Nail's. B. Presentation of Certificate to Eagle Scout Ryan Gorshe for his project at the Cibolo Animal Shelter. Certificate of Appreciation was presented,to Ryan Gorshe for his Eagle Scout Project at the Cibolo Animal Shelter. C. Presentation of Cibolo Holiday Parade awards. Certificates were given to the Holiday Parade Judges. Trophies were awarded for best decorated entry: Third place trophy was awarded to Hermann and Sons, Second place trophy was awarded to the Miss Cibolo Scholarship Pageant and first place went to Schertz Sweetheart Court. Mayor Dunn presented the Cibolo Animal Hospital with the Mayor's Trophy. Maggie Titterington was presented a plague for serving as Parade MC for the past two years. 2 D. Presentation from Saigebrook Development concerning submission of an application to Texas Department of Housing and Community Affairs(TDHA)for a Senior Living Community to be located at 2405 Green Valley Road. Presentation by Megan Lasch from Saigebrook Development on a proposed senior housing development to be built on Cibolo Valley Drive near Veterans Memorial Park and Fire Station No. 2. Ms. Lasch will coordinate with staff to see if this will be a vital project for the City. 9. Consent Agenda—Consent Items(General Items) (All items listed below are considered to be routine and non-controversial by the council and will be approved by one motion. There will be no separate discussion of these items unless a Council member so requests,in which case the item will be removed from the consent agenda and will be considered as part of the order of business.) A. Approval of the minutes of the Regular City Council Meeting held on November 23,2015. B. Approval of the minutes of the Regular City Council Meeting held on December 15,2015. C. Approval of the minutes of the City Council Workshop held on December 15,2015. D. Approval of the November 2015 Check Register pending final acceptance of the City's financial audit for the 2015/2016 Fiscal Year. E. Approval of the November 2015 Revenue and Expense Report pending final acceptance of the City's Financial audit for the 2015/2016 Fiscal Year. Councilman Doty made the motion to approve the consent agenda. Motion was seconded by Councilwoman Schultes. Court Department C. Fire Department D. Administration Chief Niemietz gave the Fire Department Report for the month of December 2015. 11. Discussion/Action Items A. Discussion/Action on the removal, appointments and re-appointments to Planning and Zoning Commission, Parks Commission, Streets and Drainage Commission, Board of Adjustments Commission, Capital Improvement Program(CII'), Charter Review Committee and Cibolo Economic Development Corporation, and all other Committees,Commissions and Boards. This item has been tabled until the City Council has a Workshop on Council Policies. B. Discussion/Action on the Gary Kelly Award. Staff was given direction to place a flyer on the web site requesting nominations for the Gary Kelly Award. 3 C. Discussion/Action and direction to staff on the Ethics Ordinance and Code of Conduct. Council briefly discussed this draft ordinance. Council decided that they would need some time to discuss this item and will schedule a workshop during item 11G. D. Discussion/Action regarding the Preliminary Acceptance of Infrastructure for Saratoga Subdivision Units 4, 9, and 11. Councilman Hogue made the motion to approve the Preliminary Acceptance of Infrastructure for the following Saratoga Subdivisions: Saratoga Subdivision, Unit 4: Public Streets: 648 Linear Feet with a valuation of $105,894.80; Sanitary Sewer: 620 Linear Feet with a valuation of$24,876.00;Drainage: Valuation of$37,585.60; Water(GVSUD): 657 Linear Feet with a valuation of$35,289.40 Saratoga Subdivision, Unit 9: Public Streets: 1,480 Linear Feet with a valuation of$220,628.55; Sanitary Sewer 1,637 Linear Feet with a valuation of $100,180.27; Drainage: Valuation of $63,552.30; Water GVSUD): 1,603 Linear Feet with a valuation of$84,144.20 Saratoga Subdivision, Unit 11: Public Streets: 1,614 Linear Feet with a valuation of$239,437.55; Sanitary Sewer 1,855 Linear Feet with a valuation of $130,829.18; Drainage: Valuation of $111,109.15; Water GVSUD): 1,640 Linear Feet with a valuation of$86,880.40 Motion was seconded by Councilman Doty. Councilman Doty made the motion to authorize the City Manager, or his designee,to negotiate and execute a contract for Engineering Design Services to reconstruct Haeckerville Road from Lower Seguin Road to I.H. 10 with GarzaBury LLC. Motion was seconded by Councilman Russell. For: Council Members: Schultes, Garrett,Gebhardt,Doty,Hogue,Russell and Weber;Against:None.Motion carried 7 to 0. F. Discussion/Action on the Citizens Barbecue Cook-off and the use of City facilities and equipment. Councilwoman Schultes made the motion to allow the Citizens Barbecue Cook-off to utilize the Council Chambers and City facilities and equipment for their event. Motion was seconded by Councilman Doty. For: Council Members: Schultes, Garrett, Gebhardt,Doty,Hogue,Russell and Weber;Against:None.Motion carried 7 to 0. G. Discussion/Action on the review and confirmation of all upcoming special meetings and workshops and scheduling the time, date, and place of additional special meetings or workshops. Council set-up a Workshop date of January 26 at 5:00 pm to go over the Ethics Ordinance. Dates for the Ethics Training required of Council, Committees, Commissions and Boards will be scheduled in February. There will be two sessions one on either February 16 or 17. The other date will be set for either Saturday February 20 or 27 whichever the City Attorney will be available. On Saturday after the Ethics training City Council will have a Workshop to go over all Council Policies and Procedures. City Secretary will contact the City Attorney and get good dates and will send out to all individuals required to attend. 4 12. Ordinance A. Approval/Disapproval of an ordinance providing for the first amendment of the Budget for the fiscal year 2015-2016. Councilman Doty made the motion to approve the ordinance providing for the first amendment of the Budget for the fiscal year 2015-2016. Motion was seconded by Councilwoman Gebhardt.
