MINUTES OF ,REGULAR COUNCIL MEETING
{ AUGUST 4, 1987
THE CIBOLO CITY COUNCIL CONVENED IN A REGULAR MEETING, AUGUST 4,
1987 AT 7:00 P.M. AT THE CIBOLO GRANGE HALL, 413 NORTH MAIN STREET,
CIBOLO, TEXAS. THE FOLLOWING ACTION WAS TAKEN:
1. CALL TO ORDER.
Mayor Bauder called the meeting to order at 7:12 P.M.
2. INVOCATION.
T.J. Harris gave the invocation.
3. ROLL CALL.
All present
* . Mayor Bauder moved the order of agenda to Item # 5.
5. THE CITY COUNCIL WILL CONVENE IN EXECUTIVE SESSION UNDER THE
PROVISIONS OF ARTICLE 6252.17 V.T.S.C. , SECTION 2(e) WHICH MAY
INCLUDE DISCUSSION OF LITIGATION:
COUNCIL TO CONFER WITH CITY ATTORNEY ON THREAT OF LITIGATION.
The council went into eXecutive session along with Mr. Harvey
Hardy, city attorney, to discuss threat of litigation.
6. RECONVENE IN OPEN SESSION AND TAKE ACTION IF NECESSARY REGARDING
EXECUTIVE SESSION.
The council reconvened in open session at 7 :30 P.M. No action
was taken.
7. HEARING, DISCUSSION AND POSSIBLE ACTION ON SUSPENSION OF OFFICER
TIMOTHY MARCAURELE. (OPEN SESSION REQUESTED BY OFFICER
MARCAURELE)
Charles Stubblefield, Attorney for Officer Marcaurele, reviewed
` - the officers employment history and medical examination required
at the time of his hiring in July, 1986. Mr. Stubblefield
requested on Mr. Marcaurele ' s behalf that he be reinstated as a
patrolman.
Chief Robert Tullgren, addressed the council as to events that
occurred in connection with the decision to extend Officer
Marcaurele ' s probation period for an additional ninety days
before evaluation of his job performance. Also, Chief Tullgren
stated events that lead to the need for "psychological
evaluation. Officer Marcaurele appeared for psychological
testing on Wednesday, July 15, 1987 to Dr. Betty Scheoder.
Testing results showed evidence that lead to the suspension on
July 24, 1987 . Chief Tullgren suspended Officer Marcaurele,
with pay, until council action.
Billie Little (Tex Farnsworth) motioned to allow continuation of
Officer Marcaurele' s ninety (90) day probation. After
discussion, T.J. Harris amended the motion "to extend the
suspension, with pay, until Tuesday, August 11 , 1987 for a
special meeting called for action. Mayor Bauder called for a
roll call vote. Vote were as follows :

All approved. Motion carried, as amended.

Mayor Bauder moved agenda order to Item # 11.
11. APPROVE/DISAPPROVE PAYMENT TO S.A. WINCO, INC. FROM THE FEDERAL
RESERVE SHARING FUND BANK ACCOUNT AND THE BALANCE OF THE
CONTRACT FROM GENERAL FUND.
Tex Farnsworth (Charlie Jupe) moved to pay S.A. Winco, Inc. for
street resurfacing from balance of Reserve Sharing Federal Fund
and the balance of the contract from General Funds. All
approved. Motion carried.
4. CITIZENS TO BE HEARD. (Limit 3 minutes)

8. DISCUSSION AND POSSIBLE ACTION ON LANDFILL.
Mayor Bauder thanked the citizens that spoke on the Buffalo
Valley Proposed Landfill and stated that the council still stood
on the resolution opposing the location of the proposed Buffalo
Valley landfill . Everyone was reminded of the public hearing in
Schertz on August 11 , 1987 at 9 :00 A.M.
9. APPROVE/DISAPPROVE �PAYMENT TO THE CITY OF-_=SCHERTZ EOR-_PORTION OF
CONTRACTORS FEE FOR"SEWER.- LIN&-,BREAK!1ON DIETZ ROAD.
Tino Delgado (Charlie Jupe) motioned to approve payment to
Schertz for one half of the contractor' s fees , on the Sewer line
repair at Dietz Road and F.M. 3009. It was the consenus that
Mayor Bauder would address Mayor Sawyer of Schertz over charges
billed, by Schertz , for the additional costs incurred during the
repair of both cities lines. All approved. Motion carried.
10. RECOMMENDATION AND POSSIBLE ACTION ON COMUTER SYSTEM.
Charlie Jupe (T.J. Harris) made recommendation to table the
computer decision until further evaluation. All approved.
Motion carried.
12. APPROVE/DISAPPROVE ONE YEAR MAINTENANCE AGREEEMENT WITH CROW
DEVELOPMENT ON THISTLE CREEK UNIT 1B.
Billie Little (Tino Delgado) made the motion to approve a one
year maintenance agreement with Crow Development. All approved.
Motion carried.

Charlie Jupe (Tino Delgado) motioned to approve as read. All
approved. Motion carried.

14. BRIEFING BY CHIEF-OF-POLICE ROBERT TULLGREN.
Chief Tullgren presented each council member with a written
report of police department activities for the past month.
15. COMMENTS BY COUNCIL.
Tex Farnsworth ask about the requirements for placing items on
the agenda.
T.J. Harris also was concerned about items on the agenda and
requests made by council members for information.
16. COMMENTS BY MAYOR.
Mayor Bauder had no comments.
17. ADJOURNMENT.
Charlie Jupe (lino Delgado) made the motion to adjourn at 10:40
P.M. All Approved. Motion carried.
