Call to Order—Meeting was called to order by Mayor Pro-Tem Hogue at 6:32pm. 2. Roll Call and Excused Absences — Council Present: Mayor Pro-Tem Hogue, Councilwoman Schultes, Councilman Garrett, Councilwoman Gebhardt, Councilman Russell and Councilman Weber; Absent: Mayor Dunn. Councilwoman Schultes made the motion to excuse the absence of Mayor Dunn. Motion was seconded by Councilman Weber. For: All; Against: None. Motion carried 6 to 0. Staff Present: City Manager Herrera, City Attorney Erkan, City Secretary Cimics, Finance Director Miranda, ED Director Luft, IT McDaniel, Fire Chief Niemietz, Police Chief Cox, Planning/Engineering Director Klein, Public Works Director Fousse, Assistant City Secretary Valdez and City Managers Assistant Rogers. 3. Invocation—Councilman Russell gave the invocation. 4. Pledge of Allegiance—All in attendance recited the Pledge of Allegiance. 5. Citizens to be Heard— This is the only time during the Council Meeting that a citizen can address the City Council. It is the opportunity for visitors and guests to address the City Council on any issue to include agenda items. All visitors wishing to speak must fill out the Sign In Roster prior to the start of the meeting. City Council may not debate any non-agenda issue, nor may any action be taken on any non-agenda issue at this time, however, City Council may present any factual response to items brought up by citizens. Dr. Keeler of Brush Trail Lane spoke of high water bills not only for him but several others that live in his area. He stated that his water meter had been changed out and they found that the reading was read incorrectly by reversing two numbers. Dr. Keeler stated people have a lack of trust with government and city officials. The city should inform people that their meter is going to be replaced and give them the opportunity to take a picture of the reading prior to it be removed. Ms. Rodriquez, Miss Freedom of the Cibolo Scholarship Pageant spoke to council on raffle tickets they will be selling to win a necklace as a fund raiser for their organization. 6. Public Hearing A.The Cibolo City Council will conduct a Public Hearing to hear public testimony concerning the voluntary annexation of the properties described below: 1 1. All properties located in the City of Cibolo's Extraterritorial Jurisdiction(ETJ) located along the west side of Haeckerville Road between Lower Seguin Road and Bolton Road and containing 37± acres. 2. All properties located in the City of Cibolo's Extraterritorial Jurisdiction (ETJ) located along the westbound IH-10 frontage and immediately east of Santa Clara Road containing 3± acres This item was briefed by the Planning staff. Mayor Pro-Tem Hogue opened the Public Hearing at 6:54pm. No citizens wish to speak and the Public Hearing was closed at 6:54pm. 7. Council will interview candidates that have filed to fill the vacant seat of Council Member District 4. Council interviewed all three candidate's that had submitted applications for this position. All members of council their given the opportunity to ask questions of the applicants (Mr. Fulford, Mr. Gibbs and Mr. Veal). Prior to going into Executive Session to discuss item 7 Mayor Pro-Tem Hogue skipped to item 11. 8. Executive Session The City Council will meet in Executive Session as authorized by the Texas Gov't Code Section 551.074 074 Personnel Matters to discuss: A. Discuss and select individual to fill the Council member District 4 seat until the November 8, 2016 election. Council went into Executive Session at 7:41pm. 9. Open Session Reconvened into Regular Session and take/or give direction, if necessary, on items discussed in Executive Session. Council reconvened into Regular Session at 8:15pm. Councilman Weber made the motion to appoint Mr. Ted Gibbs to the Council member District 4 seat until the November 8, 2016 election. Motion was seconded by Councilwoman Schultes. Mayor Pro-Tem Hogue requested a roll call vote: Councilman Weber — yes, Councilman Russell — yes, Councilwoman Gebhardt — Yes, Councilman Garrett — abstained, Councilwoman Schultes—yes and Mayor Pro-Tem Hogue—yes. For: 5,Against: None;Abstained: 1.Motion carried 5 to 0 to 1. 10. Oath of Office to District 4 Council Member.—Oath of Office was given to Ted Gibbs by the City Secretary. 11. Presentations A. Presentation of the Quarterly Award for April—June 2016 to Tonya Fullenwider. Tonya Fullenwider received the Quarterly Award for April to June from the City Manager Mr. Herrera. Tonya thanked everyone for their support during the last year and she was honored to have been nominated and selected to receive the award. Judge Phillips also spoke and stated that court would not run as smooth without Tonya's dedication and knowledge of her job. B. Presentation of a Proclamation for Domestic Violence Awareness Month. Mayor Pro-Tem Hogue presentation a Proclamation for Domestic Violence Awareness Month. 2 12. Consent Agenda—Consent Items (General Items) (All items listed below are considered to be routine and non-controversial by the council and will be approved by one motion. There will be no separate discussion of these items unless a Council member so requests, in which case the item will be removed from the consent agenda and will be considered as part of the order of business.) A. Approval of the minutes of the Regular City Council Meeting held on August 9, 2016. B. Approval of the minutes of the City Council Budget Workshop held on August 17, 2016. C. Approval of the minutes of the City Council Special Meeting held ori August 17, 2016. D. Approval of the minutes of the City Council Budget Workshop held on August 18, 2016. E. Approval of the minutes of the Regular City Council Meeting held on August 23, 2016. F. Approval of the minutes of the City Council Special Meeting held on September 6, 2016. G. Approval of the July 2016 Check Register pending final acceptance of the City's financial audit for the 2015/2016 Fiscal Year. H. Approval of the July 2016 Revenue and Expense Report pending final acceptance of the City's Financial audit for the 2015/2016 Fiscal Year. Councilman Weber made the motion to approve the consent agenda. Motion was seconded by Councilwoman Gebhardt. For: All; Against: None. Motion carried 6 to 0. 13. Staff Updates/Discussion A. Fire Department B. Court Department C. Planning &Engineering Department D. Administration New Assistant City Secretary Amanda Valdez introduced herself and told council a little about herself. She stated she was happy to be in Cibolo and looked forward to this opportunity that she has been given. 14. Discussion/Action A. Discussion/Action on the removal, appointments and re-appointments to Planning and Zoning Commission, Board of Adjustments Commission, Capital Improvement Program (CIP), Charter Review Committee, Master Plan Committee, Youth Council and Cibolo Economic Development Corporation, Animal Advisory Board and all other Committees, Commissions and Boards. No appointments made at this time. 3 B. Discussion/Action on the review and confirmation of all upcoming special meetings and workshops and scheduling the time, date, and place of additional special meetings or workshops. Council went over the calendars for September and October 2016. 15. Ordinances A. Approval/Disapproval of an ordinance of the City of Cibolo, Texas amending the City of Cibolo's Code of Ordinances Chapter 2, Article IV Boards and Commissions providing for the an Advisory Committee in matters pertaining to recreational activities, and community events. Approval/Disapproval of an ordinance of the City of Cibolo to ratify an increase of $428,311 in property tax revenues from last year's operating budget as reflected in the 2016-2017 proposed budget. Councilman Garrett made the motion to approve the ordinance that the property tax rate be increased by the adoption of a tax rate of $0.4474, which is effectively a 1.52% increase in the tax rate. Motion was seconded by Councilwoman Gebhardt. Mayor Pro-Tem Hogue called for a record vote. Motion carried 7 to 0. G. Approval/Disapproval of an ordinance of the City of Cibolo amending the drainage utility rate.
