RES 1751 02/24/2026 Purchas 0.40 acres of Real Property"City of Choice" RESOLUTION NO.1751 A RESOLUTION OF THE CITY OF CIBOLO, TEXAS AUTHORIZING THE PURCHASE OF APPROXIMATELY 0.40 ACRES OF REAL PROPERTY LOCATED AT 323 HAECKERVILLE ROAD IN THE CITY OF CIBOLO; FINDING PUBLIC PURPOSES FOR THE ACQUISITION; PROVIDING FOR SIGNATORY AUTHORITY; AND ADDRESSING RELATED MATTERS WHEREAS, as a home -rule municipality in the State of Texas, the City of Cibolo is empowered by the Texas Constitution, the City Charter, and State law, to acquire interests in real property for public purposes; and WHEREAS, the City Council of the City of Cibolo is interested in the purchase of approximately 0.40 acres of real property located at 323 Haeckerville Road in Cibolo, Texas, together with all improvements located thereon (the "Property"); and WHEREAS, the Property currently contains a structure that is deteriorated, unsafe, and inconsistent with the surrounding neighborhood, and its continued existence negatively affects the health, safety, aesthetics, and general welfare of the community; and WHEREAS, the City intends, following acquisition of the Property, to demolish and remove the dilapidated structure and to remediate the site, thereby eliminating a condition detrimental to the public and improving the livability and safety of the area; and WHEREAS, the removal of unsafe and substandard structures and the redevelopment or maintenance of property for municipal purposes constitute recognized public purposes under Texas law and are a proper exercise of the City's police powers and home -rule authority; and WHEREAS, the City Council of the City of Cibolo finds that the acquisition of the Property is necessary to accomplish a valid public purpose of the City; and WHEREAS, the City Council further finds that the purchase price for the Property is fair and reasonable in consideration of the costs necessary to remedy its current condition, and that the acquisition is in the best interest of the City and its residents; NOW, THEREFORE BE IT RESOLVED BY THE CITY OF CIBOLO: Section 1. That the foregoing recitals are hereby found to be true and correct findings of the City of Cibolo, and are fully incorporated into the body of this Resolution. Section 2. That the City of Cibolo hereby approves the purchase of the Property in the amount of $38,600.00 plus closing costs, which represents a reduction in the appraised value of $72,000.00 to account for the demolition, clearing, and other abatement activities necessary to remediate the Property condition. Section 3. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 4. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 5. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 6. This Resolution shall be in force and effect from and after its final reading, and it is so resolved. Section 7. The City Manager is authorized, empowered and directed to execute any and all transaction documents necessary for and on behalf of the City of Cibolo and in its name, that are consistent therewith and to deliver the same to effectuate this transaction.
