RES 1749 01/27/2026 Light Standards for Theo Project"City of Choice" RESOLUTION NO: 1749 A RESOLUTION OF THE CITY OF CIBOLO, TEXAS, AUTHORIZING LIGHT STANDARDS UP TO FORTY-TWO FEET IN HEIGHT FOR THE PROJECT THEO DEVELOPMENT, IN ACCORDANCE WITH THE 2024 UNIFIED DEVELOPMENT CODE, ARTICLE 7, ENVIRONMENTAL STANDARDS WHEREAS, the City of Cibolo 2024 Unified Development Code (UDC), Article 7, Environmental Standards, authorizes the Planning and Zoning Commission to review applications requesting approval to install light standards that exceed the maximum height established in the UDC; and WHEREAS, Article 7 of the UDC further authorizes the City Council to consider and approve such applications to permit the installation of light standards that exceed the maximum allowable height upon a finding that the request meets applicable criteria and serves the public interest; and WHEREAS, Project Theo, the applicant, submitted a request seeking approval to increase the maximum permitted height for light standards from thirty-five feet (35') to forty-two feet (42') within its proposed development; and WHEREAS, the Planning and Zoning Commission reviewed the application at a duly posted public meeting, considered staff recommendations and the applicant's justification, and voted to recommend approval of the requested height increase based on site -specific conditions and operational needs; and WHEREAS, Project Theo represents a significant private investment in the City of Cibolo and is projected to generate more than $1 million in combined annual ad valorem and sales tax revenue to support the City's general fund; and WHEREAS, the additional revenue generated may be used to enhance essential public safety services, support roadway repair and reconstruction, expand parks and recreation facilities, and fund other municipal programs and capital improvements that benefit the residents of Cibolo; and WHEREAS, the City has determined that allowing increased light -standard height within Project Theo will not negatively impact public health, safety, or welfare, and that the request is compatible with surrounding land uses due to the scale and function of the proposed development; and WHEREAS, all light standards installed within the development shall be designed to comply with applicable UDC requirements for shielding, light trespass prevention, glare reduction, and dark - sky protection to minimize impacts on adjoining properties and the community; and WHEREAS, the City Council has previously approved financial incentives to support the recruitment of Project Theo and to facilitate the development's long-term economic benefit to the City of Cibolo; and WHEREAS, the City Council finds that approval of the requested light -standard height increase is consistent with the intent of the UDC, supports the City's economic -development objectives, and promotes orderly development that benefits the community. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, THAT: Section 1. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as part of the judgment and finding of the City Council. Section 2. Approval of Height Increase. The City Council hereby approves the request submitted by Project Theo to authorize the installation of light standards up to forty-two feet (42') in height within the Project Theo development, in accordance with the 2024 Unified Development Code, Article 7, Environmental Standards. Section 3. Limitations and Conditions. This approval is limited exclusively to the Project Theo development and is subject to full compliance with all applicable provisions of the 2024 UDC, all lighting -design requirements regarding shielding and light -pollution mitigation, and any conditions imposed by City staff, the Planning and Zoning Commission, or the City Council. Section 4. Implementation. City staff is hereby directed to take all necessary actions to implement this Resolution, including updating all applicable City records and approvals to reflect the light -standard height authorization granted herein. Section 5. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 6. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 7. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 8. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 9. This resolution shall be in force and effect from and after its final passage, and it is so resolved. PASSED AND APPROVED on this 27 h day of January, 2026.
