ORD 1506 08/26/2025 Extension of the City Limits of CiboloOF Cie J O C r o T f X is "City of Choice" ORDINANCE NO. 1506 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE CITY LIMITS OF CIBOLO, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING APPROXIMATELY 1.3108 ACRE LOT, ABS: 110 SUR: DOMINGUEZ, LOT 1, BLOCK 1, SHOPS AT CIBOLO SUBDIVISION; LOCATED 240 BRITE ROAD, GUADALUPE COUNTY, TEXAS AND APPROVING A SERVICE PLAN FOR SUCH AREA. WHEREAS, the City of Cibolo, Texas, has received petitions requesting annexation from the owners of land that is one-half mile or less in width, contiguous to the City of Cibolo, Texas, and vacant and without residents or on which fewer than three qualified voters reside; and WHEREAS, Texas Local Government Code, Sec. 43.0067, authorizes the City of Cibolo, Texas, to voluntarily annex areas on petition of the area's landowners; and WHEREAS, in accordance with state law, the above-described petitions were filed with the City of Cibolo, Texas, on %- JL y - a..5 ; and WHEREAS, the City Council of the City of Cibolo, believing that the above-described petitions were properly filed pursuant to Texas Local Government Code, Sec. 43.0067, and believing that it is in the best interests of the City of Cibolo, granted said petition on 8-26- .2-5 ; and WHEREAS, on July 22, 2025, the City Council of the City of Cibolo, Texas, held a public hearing on the proposed annexation of a tract of land containing approximately 1.3108 acres, situated outside of but immediately adjacent to the current corporate limits of the City of Cibolo, Texas, and such public hearings gave all interested persons the right to appear and be heard on the proposed annexation of such land; and WHEREAS, notice of the above-mentioned public hearings was published in Seguin Gazette on July 20th and 23rd, 2025, a newspaper having general circulation in the City of Cibolo, Texas, and within the territory to be annexed, in accordance with law; and WHEREAS, the aforementioned public hearings were conducted not more than forty (40) days nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, the population of the City of Cibolo, Texas, is in excess of 38,000 inhabitants, and the area to be annexed lies within the extraterritorial jurisdiction of the City of Cibolo, Texas, and lies adjacent to and adjoins the City of Cibolo, Texas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, THAT: SECTION 1. ANNEXATION. The hereinafter described tract of land, being 1.3108 acres of land, ABS: I10 SUR: DOMINGUEZ, Lot 1, Block 1, Shops at Cibolo Subdivision, located at 240 Brite Road in Guadalupe County, Texas, and more particularly described in Exhibit A attached hereto and incorporated herein for all purposes, is hereby annexed into the corporate limits of the City of Cibolo, Texas, and the corporate limits of the City of Cibolo, Texas, are hereby extended to include said tract of land within the city limits, and the same shall hereafter be included within the corporate limits of the City of Cibolo, Texas, and subject to all ordinances, resolutions, rules, and regulations of the City of Cibolo, Texas. SECTION 2. SERVICE PLAN. The City Council hereby adopts the Service Plan attached hereto as Exhibit B, which sets forth the municipal services to be provided to the area annexed, and which shall be implemented in accordance with Chapter 43 of the Texas Local Government Code. SECTION 3. EFFECTIVE DATE. This Ordinance shall take effect upon its passage and publication as required by law. SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 5. PROPER NOTICE AND MEETING. It is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public as required by law, and that public notice of the time, place, and purpose of said meeting was given as required by the Texas Open Meetings Act. Exhibit B CITY OF CIBOLO ANNEXATION SERVICE PLAN SECTION 1. SERVICE PLAN Pursuant to the provisions of Texas Local Government Code Section 43.056, the following service plan is hereby adopted for the proposed annexation area: A. Services to be Provided on the Effective Date of Annexation Unless otherwise specified, the following services shall be provided in the annexed area on the effective date of annexation: 1. Police Protection o Patrolling, response to calls for service, enforcement of laws, and other routine police services by existing City of Cibolo Police Department personnel and equipment. Additional personnel will be assigned as population warrants. 2. Fire Protection o Fire suppression, rescue services, and other fire protection services by existing City of Cibolo Fire Department personnel and equipment, subject to available water supply and access limitations. 3. Emergency Medical Services o Emergency medical response and transport services through City resources or contracted providers. 4. Code Compliance and Environmental Health Services o Enforcement of health, safety, and environmental codes, including nuisance abatement, weed control, illegal dumping, regulation of on-site sewage facilities, and other public health-related ordinances. 5. Solid Waste Collection o Collection of residential solid waste at the same level of service and cost provided to other similarly situated areas within the City of Cibolo. Brush and bulky waste collection will occur as scheduled by City services. o The City will not prohibit solid waste collection by a privately owned solid waste management service provider or impose a fee on residents who choose to continue using an existing private service provider before the second anniversary of the effective date of annexation. 6. Operation and Maintenance of Public Water and Wastewater Facilities o Routine maintenance and operation of existing City -owned water and wastewater facilities not within the service area of another utility provider. New connections will follow City policies and ordinances. 7. Operation and Maintenance of Public Roads and Streets o Routine maintenance of public roads and streets on the same basis as services provided throughout the City, including pothole repair, grading of unpaved streets to meet City standards, and maintenance of traffic control devices on public streets. o Maintenance of private streets and streets on private easements shall remain the responsibility of property owners. 8. Street Lighting o Maintenance and payment for electricity for street lights on public streets shall commence on the effective date of annexation. Maintenance and electricity costs for street lights on private streets shall remain the responsibility of property owners. 9. Operation and Maintenance of Parks and Recreation Facilities o Operation and maintenance of any existing publicly owned parks, playgrounds, or recreational facilities within the annexed area. 10. Other Public Facilities and Services o Maintenance of publicly owned drainage facilities and other infrastructure as necessary and as determined by the City Engineer. 11. Zoning and Subdivision Services o Upon annexation the property shall be zoned C-3 General Retail Office B. Capital Improvements to be Undertaken Pursuant to Texas Local Government Code Section 43.056, the City shall initiate acquisition or construction of capital improvements necessary for providing full municipal services within 2 '/2 years after the effective date of annexation and substantially complete them within 4 %2 years after the effective date of annexation. The level of services, infrastructure, and maintenance shall be comparable to that provided in other areas of the City with similar topography, land use, and population density. The City is not required to provide a uniform level of services to each area if variations in topography, land use, and population density justify different levels of service. Capital improvements anticipated, if any, include: 1. Police Protection o None anticipated at this time. 2. Fire Protection o None anticipated at this time. 3. Emergency Medical Services o None anticipated at this time. 4. Solid Waste Collection o None anticipated at this time. 5. Public Water and Wastewater Facilities o Water and wastewater service will be made available at City rates from existing lines where available and not within the service area of another utility provider. o Extension of new water and wastewater lines shall be accomplished by developers as land is subdivided, consistent with City ordinances and policies. o Landowners will not be required to fund capital improvements for water or wastewater services in a manner inconsistent with Chapter 395 of the Texas Local Government Code, unless otherwise agreed. 6. Public Roads and Streets o Reconstruction, resurfacing, stone drainage installation, and other major improvements shall occur as needed under established City policies, based on traffic and development demands. o Street lighting along new streets shall be installed by developers in accordance with City ordinances when land is subdivided. o Installation of traffic control devices shall be determined by engineering studies and traffic standards. 7. Parks and Recreation Facilities o None anticipated at this time. 8.
