ORD 1505 08/12/2025 Ext. of the City Limits of Cibolo"City of Choice" ORDINANCE NO. 1505 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE CITY LIMITS OF CIBOLO, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING APPROXIMATELY 2.011 ACRES LOCATED NORTHEAST OF THE NTERSECTION OF 111 10 WEST AND SANTA CLARA ROAD, AND APPROVING A SERVICE PLAN FOR SUCH AREA. WHEREAS, the City of Cibolo, Texas, has received petitions requesting voluntary annexation from the owners of land that is one-half mile or less in width, contiguous to the City of Cibolo, Texas, and vacant and without residents or on which fewer than three qualified voters reside; and WHEREAS, Texas Local Government Code Section 43.067 authorizes the City of Cibolo, Texas, to voluntarily annex sparsely occupied areas on petition of the area's landowners; and, WHEREAS, in accordance with state law, the above-described petitions were filed with the City of Cibolo, Texas, on June 6h 2025; and WHEREAS, the City Council of the City of Cibolo, believing that the above-described petitions were properly filed pursuant to Texas Local Government Code Section 43.067, and believing that it is in the best interests of the City of Cibolo, accepted said petition on June 6" 2025; and WHEREAS, on the 22 day of July, 2025, the City Council of the City of Cibolo, Texas, held a public hearing on the proposed annexation of a tract of land containing approximately 2.011 acres, situated outside of but immediately adjacent to the current corporate limits of the City of Cibolo, Texas, and such public hearings gave all interested persons the right to appear and be heard on the proposed annexation of such land; and WHEREAS, notice of the above-mentioned public hearings was published in the Seguin Gazette on July 9d'2025, a newspaper having general circulation in the City of Cibolo, Texas, and within the territory to be annexed, in accordance with law; and WHEREAS, the aforementioned public hearing were conducted not more than forty (40) days nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, the population of the City of Cibolo, Texas, is in excess of 35,000 inhabitants, and the area to be annexed lies within the extraterritorial jurisdiction of the City of Cibolo, Texas, and lies adjacent to and adjoins the City of Cibolo, Texas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, THAT: SECTION 1. Annexation. The hereinafter described tract of land, being 2.011 acres of land located northeast of the intersection of I11 10 and Santa Clara Road, and more particularly described in EXHIBIT A attached hereto and incorporated herein for all purposes, is hereby annexed into the corporate limits of the City of Cibolo, Texas, and the corporate limits of the City of Cibolo, Texas, are hereby extended to include said tract of land within the city limits, and the same shall hereafter be included within the corporate limits of the City of Cibolo, Texas, and subject to all ordinances, resolutions, rules, and regulations of the City of Cibolo, Texas. SECTION 2. Service Plan. The City Council hereby adopts the Service Plan attached hereto as EXHIBIT B, which sets forth the municipal services to be provided to the area annexed, and which shall be implemented in accordance with Chapter 43 of the Texas Local Government Code. SECTION 3. Severability. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 4. Open Meeting Compliance. It is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public as required by law, and that public notice of the time, place, and purpose of said meeting was given as required by the Texas Open Meetings Act. SERVICE PLAT Pursuant to the provisions of Texas Local Government Code Section 43.056, the following service plan is hereby adopted for the proposed annexation area: A. Services to be Provided on the Effective Date of Annexation Unless otherwise specified, the following services shall be provided in the annexed area on the effective date of annexation: 1. Police Protection Patrolling. response to calls for service. enforcement of laws. and other routine police services by existing City of Ctbolo Police Department personnel and equipment. Additional personnel will be assigned as population warrants. 2. Fire Protection o Fire suppression. rescue services. and other fire protection senices b}• existing City of Csbolo Fire Department personnel and equipment subject to available nater supply and access limitations. 3. Emergency Medical Services o Emergency medical response and transport services through Cite resources or contacted providers. 4. Code Compliance and Environmental Health Services o Enforcement of health, safety, and environmental codes, including nuisance abatement need control, illegal dumping. regulation of on-site sewage facilities. and other public health-related ordinances. 5. Solid Waste Collection o Collection of residential solid waste at the same level of senile and cost provided to other similarly situated areas nithin the City of Crbolo. Brush and bulky waste collection will occur as scheduled by City services. o The City will not prohibit solid waste collection by a privately owned solid waste management service provider or impose a fee on residents who choose to continue using an existing private service provider before the second anniversary of the effective date of annexation. 6. Operation and Maintenance of Public Rater and Wastewater Facilities Routine maintenance and operation of existing City -owned water and wastewater facilities not within the service area of another utility provider.
