Min CC 01/28/1992 MINUTES OF REGULAR CIBOLO CITY COUNCIL MEETING TUESDAY, JANUARY 28, 1992 THE CIBOLO CITY COUNCIL CONVENED IN A REGULARLY SCHEDULED MEETING ON TUESDAYS JANUARY 28, 1992 AT 7:00 P.M. AT THE CIBOLO MUNICIPAL BUILDINGS 109 SOUTH MAIN STREETS CIBOLO, TEXAS. THE FOLLOWING WAS THE ORDER OF BUSINES: 1. CALL TO ORDER. Mayor Sam Bauder called the meeting to order at 7 :00 P.M. 2. ROLL CALL. Present: Jeff Miller Mayor Bauder Bob Glisar Absent: Tino Delgado/business Mark Buell Tex Farnsworth Staff Present: David Walker Ann Smith 3. INVOCATION. Councilmember Tex Farnsworth gave the invocation. 4. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge. 5. CITIZENS TO BE HEARD. Ed Baxter, Chief of Police in Marion, introduced himself and announced that he was running for County Commissioner, Pct. 3 and would like to ask for the Council ' s support. 6. CONSENSUS ITEMS: A. MINUTES OF REGULAR MEETINGS JAN. 14, 1992. Tex Farnsworth (Mark Buell seconded) motioned to approve as presented. All approved. Motion carried. 7. PRESENTATION/ACTION ON THE 1990-91 AUDIT/FINANCIAL REPORT FROM THE FIRM OF ARMSTRONG. MELICR & VAUGHAN - PRESENTED BY NANCY VAUGHAN. Tex Farnsworth (Bob Glisar seconded) motioned to accept the 1990-91 Audit & Financial Report from the firm of Armstrong, Melick and Vaughan. All approved. Nancy Vaughan summarized the audit report and management letter. Mrs. Vaughan stated that the financial structure of the city was sound and that all tests on the accounting showed no areas of concern. The report reflected a "write off" of some $55,059 in the proprietary funds due to a note from Thistle Creek Development to the City of Cibolo for their portion of funding a water transmission line from the main tank to Thistle Creek Subdivsion. The property was foreclosed on by NCNB in May, 19.91; therefore, it was felt that recovery of these funds was not probable. Also, it was noted that the city did not receive the GFOA Certificate of Excellence Award in which we applied for the first time with the FY 1989-90 financial report. Mrs. Vaughan stated that only one area kept us from receiving the award and that that had been been corrected. The GFOA had stated that they would review th'e 1990-91 at no charge. 8. APPROVAL/DISAPPROVAL OF CHARGE OFF OF DELINQUENT UTILITY ACCOUNTS. Tex Farnsworth (Mark Buell seconded) motioned to charge $4, 6019 of delinquent utility accounts. It was discussed that the staff should look into an outside collection firm and also the possiblities of changing our connection fee to include a refundable deposit. All approved. Motion carried. i MINUTES OF REGULAR COUNCIL MEETING (cont) January 28, 1992 9. APPROVE/DISAPPROVE APPOINTMENT TO THE PLANNING & ZONING COMMISSION. Tex Farnsworth (Jeff Miller seconded) motioned to accept the P & Z recommendation on appointing Mr. Mark D. Faires to serve on the P & Z Commission. All approved. Motion carried. 10. EXECUTIVE SESSION: THE CITY COUNCIL MAY GO INTO A CLOSED EXECUTIVE SESSION PURSUANT TO THE PROVISIONS OF THE OPEN MEETING LAW, ART. 6252.17 V.T.C.S. , IN ACCORDANCE WITH THE AUTHORITY CONTAINED IN SECTION 2(g) : A. RESIGNATION OF PATROL OFFICER. B. AUTHORIZATION TO ADVERTISE FOR PATROL OFFICER. Jeff Miller (Tex Farnsworth seconded) motioned to suspend with'- the closed session and accept the resignation of William Lee Richerson effective Feb. 3, 1992. All approved. Motion carried. Tex Farnsworth (Jeff Miller seconded) motioned to authorize the staff to advertise for a patrol officer as soon as possible. All approved. Motion carried. 11. RECONVENE IN OPEN SESSION AND TAKE NECESSARY ACTION. Not necessary due to action on item # 10 A & B. 12, COMMENTS BY COUNCIL MEMBERS. Tex Farnsworth noted that the Guadalupe County Youth Show & Auction would be Saturday in Seguin. 13. COMMENTS BY STAFF. David Walker noted that due to the heavy rains , potholes were extremely bad and ask that the citizens bear with us until the weather and time allowed us to mend them. 14. COMMENTS BY MAYOR. Mayor Bauder noted that the Recorder Times Newspaper would no longer by serving the metrocom area. 15. ADJOURNMENT. Tex Farnsworth (Bob Glisar seconded) motioned to adjourn at 7:50 p.m. All approved.
