Tax19 *11]iliy a$rLi6SI0 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS TO RATIFY THE INCREASE IN PROPERTY TAX REVENUES FROM THE PREVIOUS YEAR. WHEREAS, Section 102.007(c) of the Texas Local Government Code provides that adoption of a budget that will require raising more revenue from property taxes than in the previous year requires a separate vote of the governing body to ratify the property tax increase reflected in the budget; and WHEREAS, that a vote under Section 102.007(c) is in addition to and separate from the vote to adopt the budget or a vote to set the tax rate; WHEREAS, in accordance with Local Government Code 102.005, the following statement was made on the cover of the proposed budget based on the maximum tax rate set by City Council: This budget will raise more total property taxes than last year's budget by $3,479,717 (22.87%), and of that amount $1,085,234 is tax revenue to be raised from new property added to the tax roll this year. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION 1 Findings: The recitals are hereby found to be true and correct and are hereby incorporated as part of this Resolution. SECTION 2 The facts and recitations contained in the preamble of this Resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 3 The proposed fiscal year 2025 budget will require raising more property tax revenue than the prior year budget. The property tax increase reflected in the fiscal year 2025 budget is ratified with the following declaration: This budget will raise more total property taxes than last year's budget by $2,363,141 (15.50/6), and of that amount $1,020,410 is tax revenue to be raised from new property added to the tax roll this year. SECTION 4 That it is hereby declared to be the intention of the City Council of the City of Cibolo that the phrases, clauses, sentences, paragraphs, and sections of this Resolution are severable, and if any phrase, clause, sentence, paragraph or section of this Resolution should be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of the Resolution, since the same would have been enacted by the City Council without incorporation in this resolution of any such unconstitutional phrases, clause, sentence, paragraph or section. SECTION 5 EFFECTIVE DATE This Resolution shall take effect and shall be in full force at 12:00 a.m. on October 1, 2024. PASSED AND APPROVED AND ADOPTED THIS 19TH DAY OF AUGUST, 2024.
