Min CC 06/28/1994 MINUTES O F C I TY COU N C I L ME ET I N G THE CIBOLO CITY COUNCIL CONVENED IN A REGULARLY SCHEDULED MEETING ON TUESDAY, JUNE 28, 1994, AT 7 :00 P.M. AT THE MUNICIPAL BUILDING, 109 SOUTH MAIN STREET, CIBOLO, TEXAS. THE FOLLOWING WAS THE ORDER OF BUSINESS: I . CALL TO ORDER. Mayor called to order at 7 :00 p.m. II . ROLL CALL. All members were present. Staff was represented by Ron Flake, Chuck Balcar, Wes Suiter and Keith Gilbreath. III . INVOCATION. Bob Glisar provided the opening prayer. IV. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge. V. CITIZENS TO BE HEARD. (LIMIT 3 MINUTES EACH) Jerry Garrison discussed vehicles going from Borgfeld down the road behind Thistle Creek. He requested that barriers be placed at the end of Thistle Creek and Borgfeld Road. The Police stated that when the man who was grazing cattle moved, he took the fence (barricade) with him. Keith Gilbreath said he would talk to the developer about blocking the entrance. VI . CONSENSUS ITEMS: A. APPROVAL OF MINUTES OF June 14, 1994 Motion by Mark, second by Jeff . Approved. VII . PRESENTATION OF GUADALUPE APPRAISAL DISTRICT BUDGET FOR 1994-95 Pat Fox of the district presented the proposed budget for 1994- 95 . The budget will be increased about seven percent, mainly due to addition of another appraiser. The major increase in non- 6-28-94 page 2 of 4 _ Ms . Fox discussed the procedure for investigating "ag exempt" properties and said that the new hire would result in a stronger enforcement effort in determining if properties are properly receiving tax exemptions for agricultural property. Chuck Balcar stated that about ten percent of the property in Cibolo currently receives this exemption. She said that Council would be notified of the Public Hearing on the budget. VIII . ORDINANCE TO AMEND CITY OF CIBOLO ORDINANCE #410 SETTING THE WATER RATES. REQUIRING A DEPOSIT FOR CONNECTION TO THE CITY OF CIBOLO WATER SYSTEM AND ADJUSTMENT OF CONNECTION FEES Mark made a motion to open discussion on Ordinance #442, Jeff seconded. The Council was told that 13-15 people would receive the lower rate and three residences would fall into the highest surcharge classification. Jeff asked how the trailer court would be affected and was told that a deposit would be required. Ron Flake said if we shut off water for non-payment, we could require a deposit as a condition of reconnecting the service. Mark summed up the ordinance as rewarding conservation and penalizing water wasters . . .Ron added that it also will require deposits. The Mayor asked if it had to be advertised and Mark recommended that an ad be taken out . . .Ron said it was not absolutely be required but to be safe we could advertise. Mark made a motion that the new rates be advertised and the new rates be effective August 1, 1994. Second by Jeff . Approved. IX. WORKSESSION ON COUNCIL PRIORITIES, BUDGET IN FY 1994-95 Chuck Balcar presented the current expenditures and estimated commitments for the rest of the year and asked the Mayor and Council for their priorities for the coming budget year. Chuck Ridge asked for surveys of salaries of other cities and wanted to bring Cibolo salaries more in line with compensation in other cities. Mark asked about the increase in expenditures for animal control . Jeff asked about plumbing permits being projected lower and it was explained that we will not reach the budgeted amount this year. Mark said he wanted to continue the fiscally conservative posture on the city. 6-28-94 page 3 of 4 - Mark also wanted more money in street maintenance and pay off debt. X. VARIANCE TO PLACE A SALES TRAILER ON LOT 1 AND 2 IN SECTION 2 OF PHASE 1 IN DEER CREEK (SCOTT FELDER HOMES) Jeff recommended approval and Norman seconded the motion. The trailer will be located off of FM 3009. Approved. XI . EXECUTIVE SESSION PURSUANT TO SECTION 551 .071, (1) , (A) & (B) OF THE TEXAS GOVERNMENT CODE A. TO CONSULT WITH CITY ATTORNEY CONCERNING PENDING LITIGATION WITH DAVID WALKER The Mayor called for the session to begin at 7 :53 p.m. . B. RECONVENE IN OPEN SESSION FOR ANY NECESSARY ACTION The Mayor reconvened the session at 8 :38 p.m.Chuck Ridge motioned that the City attorney begin negotiations with David Walker. Seconded by Jeff Miller. Four voted in favor and Norman voted opposed. XII . COMMENTS BY COUNCIL MEMBERS XIII . COMMENTS BY STAFF Keith prepared info on the road. Ron Flake said we need to go back with the correct law and cite them and asked for a compromise. Chuck Balcar said that Steve Simonson of Schertz will support our actions on getting Dietz Road improved. The cost estimates for the Main Street Drainage project will be presented at the next Council meeting. The current garbage contract is due to expire and the contract ,may be sent back out for bid or renegotiated. Ron said he felt we had to go out for bid. 6-28-94 page 4 of 4 XIV.
