RESOLUTION NO. 1657
RESOLUTION BY THE CITY OF CIBOLO, TEXAS AUTHORIZING THE
GRANT OF PUBLIC FUNDS IN SUPPORT OF THE VETERANS POW
WOW, FINDING THE GRANT OF PUBLIC FUNDS IS FOR A PUBLIC
PURPOSE; AUTHORIZING THE CITY MANAGER TO DISPENSE
PUBLIC FUNDS; REQUIRING THE RETURN OF UNUSED FUNDS;
PROVIDING FOR REPEAL AND SEVERABILITY; DETERMINING
THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED
WAS CONDUCTED IN COMPLIANCE WITH THE TEXAS OPEN
MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE.
Whereas, the City Council of the City of Cibolo, Texas finds the Cibolo Veterans Pow Wow Event
(the Pow Wow) is a weekend event designated to promote cultural awareness of Native Americans
indigenous to Texas and Northern Mexico; and
Whereas, the City Council finds awarding a grant of public funds to support the Pow Wow
provides recognition to Native Americans who served Texas and the United States and to all
veterans for their performance of United States and Texas military service; and
Whereas, the City Council finds awarding a grant of public funds in support the Pow Wow
provides the public with educational information regarding Native American history, traditions,
activities and serves to sustain Native American culture in the community; and
Whereas, the City Council finds the Bison Foundation Corporation will use the public funds
provided by this grant to provide for the health, safety, and welfare of citizens and out-of-town
attendees who attend the Pow Wow and better ensure a safe and welcoming event; and
Whereas, the City Council finds that the grant of public funds provided by the resolution provides
for advertising and promotion the program in Cibolo, attracting tourists, promoting the arts,
preserving Native American and veteran history, and encouraging tourists to visit historic sites and
museums; and
Whereas, the City Council finds that the Bison Foundation Corporation will account for the
expenditure of the funds by providing receipts which are relevant to the event, documenting the
manner in which the grant was spent, to evidence the use of the funds promoted the public purposes
stated herein, within 30 days after the event; and
Whereas, the City Council finds that in the event the Bison Foundation Corporation fails to
account for the expenditure of the funds as provided in this resolution, it must return any funds
unaccounted for within 10 days of a request made by the City for the return of any unaccounted
for grant monies provided by the City,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CIBOLO,TEXAS THAT:
1) The recitals are hereby found to be true and correct and are hereby incorporated as part of
this Resolution.
2) This grant is an appropriate use of funds as it supports the public purposes stated herein.
3) The City of Cibolo grants five -thousand dollars ($5,000) to the Bison Foundation
Corporation for its use in producing the Cibolo Veterans Pow Wow event scheduled in
April 2024 in Cibolo, Texas.
4) The City Manager is authorized to dispense the grant funds provided by this Resolution.
5) The Bison Foundation Corporation must agree in writing to account for the use of the funds
and provide receipts within 30 days after the event as a condition precedent to receiving
this grant.
6) The City shall request the return of any unaccounted-for grant monies provided by the City
after the expiration of 30 days after the event, if any grant funds are unaccounted for.
7) This Resolution shall be and is hereby cumulative of all other resolutions of the City of
Cibolo, Texas, and this resolution shall not operate to repeal or affect any of such other
resolutions except insofar as the provisions thereof might be inconsistent or in conflict with
the provisions of this Resolution, in which event such conflicting provisions, if any, in such
other resolutions are hereby repealed.
8) If any section, paragraph, sentence, clause, or phrase of this Resolution shall for any reason
be held to be unconstitutional or invalid by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this Resolution.
9) The City Council hereby finds and determines that the meeting at which this Resolution
was passed was conducted in accordance with the Texas Open Meetings Act.
10) This Resolution shall become effective and be in full force and effect from and after the
date of passage and adoption by the City Council of the City of Cibolo, Texas.
