Call to Order— Meering was called to order at 6:34pm by Vice Chairman Ms. Hale. 2. Roll Call and Excused Absences — Members Present: Ms. Hale, Mr. Benson, Mr. Hicks, Mr. Frias, Ms. Latimer, and Ms. Delgado; Members Absent: Mr. Dufresne; Staff Present: Mr. Klein, Ms. Gonzalez, Mr. Dale and Ms. Cimics. 3. Invocation/ Moment of Silence —Ms. Hale ask for a Moment of Silence. 4. Pledge of Allegiance — All in attendance recited the Pledge of Allegiance. 5. Citizens to be Heard This is the only time during the Planning and Zoning Commission meeting that a citizen can address the Planning and Zoning Commission. It is the opportunity for visitors and guests to address the Commission on any issue to include agenda items. All visitors wishing to speak must fill out the Sign -In Roster prior to the start of the meeting. Planning and Zoning Commission may not debate any non -agenda issue, nor may any action be taken on any non -agenda issue at this time however the Planning and Zoning Commission may present any factual response to items brought up by citizens. (Attorney General Opinion — JC 0169) (Limit of three minutes each). All remarks shall be addressed to the Commission as a body, and not to any individual member thereof. Public criticism of the Commission or any action, policy program or service provided by the City is not prohibited. However, any person making personal, impertinent, or slanderous remarks to individual members of the Commission while addressing the Commission may be requested to leave the meeting. The following individuals spoke at Citizens to be Heard: Penny Jennings spoke on the apartments planned at FM 1103 and Wiederstein. She was concerned with more traffic on already crowded roads and additional students at the schools. Don Schaezler and Susan Schaezler were against the re -zoning. They were concerned about pollution and litter in the area of the Wildlife Sanitary. Michelle Womack opposed apartments as schools are already overcrowded and more cars will be cutting thru the neighborhood. Nick Bettencourt was opposed to apartments being located at FM 1103 and Old Wiederstein as the school already have portable buildings. He was concerned about additional traffic by the schools and the safety of the children. Adalberto Morales opposed re- zoning and apartments due to increase traffic, noise pollution, and safety of school children. Brett Lum spoke for the landowner and stated that there was 35 acres and was too large for just commercial. The landowner has been trying to sell this property for over 5 years. A mix -use for this property would be similar to the Cibolo Crossing site. Tanya Philippi also spoke against apartments due to increase traffic and noise pollution. She felt commercial would be more desirable for this location. Dana Eldridge was opposed to apartments. At the present he is able to look out his backyard at the birds and would not want this to change. Traffic would be a problem and he stated other places in Cibolo would be better for apartments. 6. Consent Agenda A. Approval of the minutes from November 13, 2019. Ms. Latimer made the motion to approve the November 13, 2019 minutes as corrected. Motion was seconded by Mr. Benson. For: All; Against: None. Motion carried 5 to 0. B. Approval of the minutes of January 8, 2020. Mr. Benson made the motion to approve the minutes of January 8, 2020. Motion was seconded by Ms. Latimer. For: All; Against: None. Motion carried 5 to 0. 7. Public Hearings A. The City of Cibolo Planning and Zoning Commission will hold a public hearing to hear public testimony regarding an update to the Future Land Use Map of 16 acres located approximately at the southwest corner of FM 1103 and Old Wiederstein Road from the current Commercial designation to Transitional Residential. This item was briefed to the P&Z commission by Mr. Dale. Ms. Hale opened the public hearing at 7:08pm. The following individuals spoke in opposition of an update to the Future Land Use Map: Don Schaezler, Frank McCovey, Susan Schaezler, Robert Grain, Nolan Daniels, Dana Eldridge, Louisa Wise and Roslanda McCombie. Brent Lum clarified his map. Ms. Hale closed the public hearing at 7:32pm. B. The City of Cibolo Planning and Zoning Commission will hold a public hearing to hear public testimony regarding a rezoning of 16 acres located approximately at the southwest comer of intersection FM 1103 and Old Wiederstein Road from the current zoning of Retail/Office (0) to Multi -Family (MF -1). Mr. Dale from the Planning Department briefed this item to the P&Z. Mr. Dale stated that these apartments would be garden type apartments. Ms. Hale opened the public hearing at 7:35pm. The following individuals spoke in opposition of the rezoning. Susan Schaezler, Don Schaezler, Penny Jennings and Dana Eldridge. Ms. Hale closed the public hearing at 7:41pm. 8. Discussion/Action Items A. Discussion/Action and recommendation to the City Council regarding an update to the Future Land Use Map of 16 acres located approximately at the southwest comer of intersection FM 1103 and Old Wiederstein Road from the current Commercial designation to Transitional Residential. This item was briefed by Ms. Gonzalez. Mr. Frias made the motion to recommend a disapproval to the City Council regarding an update to the Future Land Use Map of 16 acres located approximately at the southwest corner of intersection FM 1103 and Old Wiederstein Road from the current Commercial designation to Transitional Residential. Motion was seconded by Ms. Latimer. For Denial: All; Against: None. Motion carried 5 to 0. B. Discussion/Action and recommendation to the City Council regarding a rezoning of 16 acres located approximately at the southwest corner of intersection FM 1103 and Old Wiederstein Road from the current zoning of Retail/Office (0) to Multi -Family (MF -1). Motion was made by Mr. Frias to recommend to City Council denial regarding a rezoning of 16 acres located approximately at the southwest corner of intersection FM 1103 and Old Wiederstein Road from the current zoning of Retail/Office (0) to Multi -Family (MF -1). Motion was seconded by Mr. Benson. For Denial: All; Against: None. Motion carried 5 to 0. 9. UDC, CIP, Master Plan and Staff Updates Ms. Gonzalez briefed the commission that next week there will be a joint Council/P&Z/EDC/UDC Meeting. After the completion of that meeting the UDC will meet one more time to look over any changes made during the joint meeting. Staff updates were in the packet if anyone has questions they can call staff. 10. Items for future agendas — Mr. Benson would like an update from the Economic Development Department. 11.
