RES 1201 6/12/2001A RESOLUTION OF THE CITY OF CIBOLO IN SUPPORT OF THE GUADALUPE-BLANCO RIVER AUTHORITY'S REQUEST TO THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION TO AMEND CANYON PERMIT CERTIFICATE OF ADJUDICATION NO. 18-2074 AND URGING IMMEDIATE ISSUANCE OF THE PERMIT AMENDMENT WHEREAS, the members of the City Council of Cibolo are duly -elected to represent the citizens of the City of Cibolo, and WHEREAS the management and protection of natural resources, including water resources, are of vital importance to the citizens of the City of Cibolo, and WHEREAS the Guadalupe River Basin and region are experiencing dynamic growth and Increased demands for water, and WHEREAS portions of the Basin rely on the Trinity Groundwater Aquifer, the Edwards Aquifer, the Guadalupe River and Canyon Reservoir as sources of water, and WHEREAS the Edwards and Trinity aquifers have limited water supplies and have, in recent years, been unable to fully meet the Increased demands of a growing population, and WHEREAS the Guadalupe -Blanco River Authority (GBRA) is a state agency, mandated to develop, conserve and protect the water resources of the Guadalupe River Basin, and WHEREAS Canyon Reservoir is the only firm yield water storage and supply structure in the 21 '/2 county Region L water planning area, and WHEREAS Canyon Reservoir was constructed as a multipurpose reservoir to provide flood control and water supply benefits to this Basin, and WHEREAS the permit amendment requested by GBRA and the additional water it will provide are key components of the Region L and proposed State Water Plan, and WHEREAS GBRA was the local sponsor for the construction of Canyon Reservoir and holds a state water right permit to store water in the Reservoir and deliver up to an average of 50,000 acre- feet of water annually to municipal, Industrial and agricultural customers of GBRA, and WHEREAS in 1997, GBRA applied to the Texas Natural Resource Conservation Commission (TNRCC) to amend this permit and Increase the authorized annual amount to 90,000 acre-feet per year, and WHEREAS this request is based on numerous hydrologic studies since the 1960's by GBRA engineers, the TNRCC staff and the staff of the TWDB confirming Canyon Reservoir's ability to deliver more water without negatively affecting senior water rights, environmental flows, or having significant long-term impacts on the level of the lake, and WHEREAS Canyon Reservoir's Increased supply Is critical to sustaining human fife, and WHEREAS this same Increased supply is needed now to prevent overpumping of area aquifers, including the Edwards and Trinity Aquifers, and WHEREAS this amendment provides the source for several vital regional water supply projects that will benefit numerous entities including the cities of Kerrville, Boerne, Fair Oaks Ranch, Bulverde, New Braunfels, San Marcos, Victoria, Kyle, Buda and the Comal ISD, and WHEREAS, the effect on Canyon Lake will be minimal In that TNRCC's additional instream flow requirements that will be part of the new permit amendment will actually increase flows downstream of the lake during normal times, and WHEREAS downstream flows will also be significantly increased during drought periods due to the deliveries of the additional stored water from Canyon Reservoir, NOW THEREFORE, BE IT RESOLVED that the City Council of Cibolo confirms Its support of the Guadalupe -Blanco River Authority's pending application to TNRCC to amend its existing Canyon. Reservoir water right, Certificate of Adjudication No. 18-2074 and hereby requests the duly -appointed Commissioners of the Texas Natural Resource Conservation Commission to approve the permit amendment without delay. The Commission has received dozens of letters of support from local officials and entities, and state elected officials, emphasizing the importance of this additional water supply.
