Min BOA 5/8/2023Board of Adjustment Meeting City of Cibolo 200 S. Main St. May 8, 2023 6:30 p.m. — 9:30 p.m. NI_ITU y_ _ _. 1. Call to Order —Meeting was called to order by Chairman Mr. Frias at 6:30 p.m 2. Roll Call and Excused Absences —Members Present: Mr. Frias, Mr. MacLauchlan, Mr. Ragland, and Mr. Peek. Members Absent: Mr. Smith, Ms. Forsberg, and Ms. Falcon. Mr. Ragland made the motion to excuse the absence of both Mr. Smith and Ms. Forsberg. Motion was seconded by Mr. Peek. For: All; Against: None. Motion carried 4 to 0. 3. Invocation/Moment of Silence— Mr. Frias asks for a Moment of Silence. 4. Pledge of Allegiance —All in attendance recited the Pledge of Allegiance. 5. Citizens to be Heard This is the only time during the Board Meeting that a citizen can address the Board. It is an opportunity for visitors and guests to address the Board on any issue to include agenda items. All visitors wishing to speak must fill out the Sign -In Roster prior to the start of the meeting. The Board may not debate any non -agenda issue, nor may any action be taken on any non -agenda issue at this time; however, the Board may present any factual response to items brought up by citizens. (Attorney General Opinion — JC -0169) (Limit of three minutes each.) All remarks shall be addressed to the Board as a body, and not to any individual member thereof. Public criticism of the Board or any action, policy program or service provided by the City is not prohibited. However, any person making personal, impertinent, or slanderous remarks to individual members of the Board while addressing the Board may be requested to leave the meeting. This meeting is livestreamed. The following individual spoke at this time: David Meditz stated that he had lived in Cibolo since 1997. He said that he was familiar with the area as he owned the property at 130 Cove Lane many years ago. There were many mistakes made by the Planning & Zoning, the City Engineer, and builders over the years on allowing development in a flood area. Mr. Meditz stated that approving item 8A will affect all citizens of Cibolo. 6. Consent Agenda A. Approval of the minutes from February 27, 2023. Mr. Ragland made the motion to approve the consent agenda. Motion was seconded by Mr. MacLauchlan. For: All; Against: None. Motion carried 4 t 0. 7. Public Hearings A. The City of Board of Adjustment will conduct a public hearing to hear public testimony regarding a variance request to Section 14.2.0.2 of the UDC to increase the allowable maximum impervious coverage within the Low -Density Single -Family (SF -2) District from 35% to 58% for certain real property located at 114 Bay Hill Drive. This item was briefed to the members of the Board of Adjustments by Ms. Walker of the Planning Department. Mr. Frias opened the public hearing at 6:38 p.m. The individuals spoke during this item. Mr. Jones stated that he was zoned C-2 and he wanted to know how a developer was able to build so many homes. He would also like to know the history and the future for the Enclave at Riata Oaks. Mr. Meditz spoke as a member of the Bentwood Ranch HOA. Mr. Meditz said that the homeowner's association was responsible for drainage culvert behind these homes. He stated tht 130 Cove Lane was not part of Cibolo when homes started to be built in this area. Cibolo did not have regulations in place as we do today. Previous City Councils, Planning Staff, and Planning Commissions let homes be built that were prone to flooding. When Mr. Akins came before the council asking for a change in zoning so he could build more homes no one thought what this would do to citizens in the future. Mr. Meditz also stated that the City Engineer would not verify anything and just accepted documents. He also understands that we now have different individuals in that department. Ms. Chambers wanted to know if a decision on this item would be made at this meeting. Ms. Jones made the statement that the home shown on the screen with the #2 has a large amount of water in the front of the home all the time. It attracts mosquitoes and smells. She was not sure if this was a cause of run-off in the area. Ms. Bland stated that they have problems with run-off every time it rains. She will have flooding at the side of her house and in the backyard. Mr. Hinze said that his family has pastures in this area, and they had flooding when subdivisions started to be built. When oversize detention ponds were built that helped with the flooding. Mr. Hinze also stated that individuals speaking stating they were zoned C-2 most likely meant SF -2 as stated on the city map. Although the map states SF -2 homes were built to the SF -6 zoning standards. Ms. Meditz also spoke on the run-off and the flooding in the backyards. Mr. Frias closed the public hearing at 7:10 p.m. 8. Discussion/Action Items A.
