ORD 557 04/23/2002ORDINANCE NUMBER 615-7 AN ORDINANCE ANNEXING THE HEREIN AFTER DESCRIBED TERRITORY TO THE CITY OF CIBOLO, TEXAS AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SUCH PROPERTY WITHIN THE CITY LIMITS. WHEREAS, a petition for annexation has been heretofore filed by Mr. Bob Dean, being the owner of certain land in the extra -territorial jurisdiction of the City of Cibolo, Guadalupe County, Texas said land being described in paragraph 1 below, and WHEREAS, said petition in form and substance, fully complies with all of the provisions of Section 43.028, Local Government Code, V.A.T.S. and WHEREAS, said tract of land is contiguous and adjacent to the City of Cibolo, is not more than one-half mile in width and is vacant and without residents; and WHEREAS, the City Council is of the opinion that said petition should be granted and that such tract of land should be annexed to the City; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS 1. That the following described property, to wit: Being 49.21 acres of land situated in the B. Cannon Survey, Abstract No. 95, Guadalupe County, Texas, being out of a 228.5 acre tract as recorded in Volume 1258, Page 343, Official Public Records of Guadalupe County, Texas, and being more particularly described by metes and bounds as follows: COMMENCING at a found %z" rebar on a common corner of said B. Cannon survey and the James Jones Survey, Abstract No. 194, said point being on a reentrant corner on the northeast right-of-way line of Cibolo Valley Drive (R.O.W. — 86'), Springtree Subdivision Unit 2, approved by the city Council of Cibolo on June 26, 2001, but unrecorded at this time, being the northwest corner of Tract 2, a 6.137 acre tract recorded in Volume 1567, Page 444, Official Public Records of Guadalupe County, Texas, being also on the southeast line of a 1.4309 acre tract recorded in Volume 998, Page 60, Official Public Records of Guadalupe county, Texas; Thence N.60'1 1'52:E., departing said right-of-way line and along the common lines of said B. Cannon and James Jones Surveys, being also the northeast line of said Tract 2, a distance of 231.64 feet to a set %i' rebar with a Castella and Assoc. plastic cap for the POINT OF BEGINNING, and the southwest comer of this tract; THENCE N.29°1751 "W., passing a found % rebar at the common corner of said 1.4309 acre tract, and the remaining portion of a 87.15 acre tract recorded in Volume 1443, Page 379, Official Public Records of Guadalupe county, Texas, at 201.02 feet, a total distance of 1144.29 feet to a found ''/z' rebar at the northeast comer of said remaining portion of a 87.15 acre tract, being an angle point of a 63.325 acre tract recorded in Volume 1609, Page 724, Official Public Records of Guadalupe County, Texas, for the northwest comer of this tract; THENCE N.60°53'20E., along the southeast line of said 63.325 acre tract, a distance of 708.96 feet to a found %i rebar for an angle point; THENCE N.60°29'45"E., continuing along said southeast line, a distance of 728.99 feet to a found "X" in concrete at the common corner of said 63.325 acre tract and a 10.00 acre tract recorded in Volume 657, Page 590, Deed Records, Guadalupe County, Texas, for an angle point; THENCE N.60°10'27"E., along the southeast line of said 10.00 acre tract, a distance of 355.14 feet to a found 1/2" rebar at the common comer of said 10.00 acre tract, and a 31.572 acre tract recorded in Volume 1510, Page 233, Official Public Records of Guadalupe County, Texas, for an angle point; THENCE N.60°29'31 "E., along a southerly line of said 31.572 acre tract, a distance of 89.35 feet to a point for a northeast corner of this tract; THENCE S.29°48'03"E., with the Cibolo City Limit Line and leaving the southerly line of said 31.572 acre tract and crossing the aforementioned 228.5 acre tract, a distance of 113 1.5 9 feet to a found %" rebar on the aforementioned common lines of said B. Cannon and James Jones Surveys, being the northeast comer of a 29.59 acre tract recorded in Volume 1113, Page 1, Official Public Records of Guadalupe County, Texas, for an angle point and the southeast comer of this tract; THENCE S.60° 11'52"W., along said common survey line, passing a found Y' rebar, a common corner of said 29.59 acre tract and the remaining portion of a 40.0 acre tract recorded in Volume 544, Page 693, Deed Records, Guadalupe County, Texas, at a distance of 789.34 feet, passing a common comer of said remaining portion of a 40.0 acre tract, and a remaining portion of a 39.44 acre tract, recorded in Volume 566, Page 885, Deed Records, Guadalupe County, Texas, at a distance of 1069.24 feet, passing a found %' rebar, the common comer of said remaining portion of a 39.44 acre tract, and Tract3, a 6.137 acre tract recorded in Volume 1614, Page 266, Page 266, Official Public Records of Guadalupe county, Texas, at a distance of 1452.21 feet, passing a found %z" rebar, the common corner of said Tract 3 and the aforementioned Tract 2, a distance of 1781.32 feet, continuing on with a total distance of 1892.44 feet to the POINT OF BEGINNING, and containing 49.21 acres or land, more or less. The basis of bearing recited herein is the plat of Springtree Subdivision Unit 1, recorded in Volume 6, Page 348, Plat Records of Guadalupe County, Texas. This description was prepared from a survey made on the ground by employees of W.F. Castella and Associates, Inc. There is a plat of survey with the like job order. Section 3.
