ORD 542 9/25/2001ORDINANCE NUMBER 54 � FOR ADOPTION OF THE INTERNATIONAL BUILDING CODE AN ORDINANCE OF THE Crry of ClaoLo ESTABLISHING THE MINEAUM REGULATIONS GOVERNING THE CONDITIONS AND MAINTENANCE OF ALL PROPERTY, BUILDINGS AND STRUCTURES; BY PROVIDING THE STANDARDS FOR. SUPPLIED UTILITIES AND FACILITIES AND OTHER PHYSICAL THINGS AND CONDITIONS ESSENTIAL, TO ENSURE THAT STRUCTURES ARE SAFE, SANITARY AND FIT FOR OCCUPATION AND USE; REPEALING ORDINANCE NO. 507 OF THE CITY OF CMOLO AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH. AND THE CONDEMNATION OF BUILDINGS AND STRUCTURES UNFIT FOR HUMAN OCCUPANCY AND USE AND THE DEMOLITION OF SUCH STRUCTURES; KNOWN AS THE INTERNATIONAL BUILDING CODE. The Mayor and City Council of the City of Cibolo ordains as follows: Section 1. That a certain document a copy, of which is on file in the office of the Code Enforcement Officer of the City of Cibolo, being marked and designated as the International Building Code, including all Appendices Chapters, as published by the International Code Council, Inc., be and is hereby adopted as the International Building Code for the City Of Cibolo in the State of Texas; for the control of building and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Building Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 2 of this ordinance. Section 2. The following sections are hereby revised: 10 1. 1 Title. These regulations shall be known as the International Building Code of the City Of Cibolo hereinafter referred to as "this code." 108.2 Schedule of permit fees. On buildings, structures, moves, demolition or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority. Total Valuation Fee $1,000 and less $15.00 fee for each the first $1,000.00 $1,000 to $50,000 $15.00 for the first $1,000.00 plus $5.00 for each additional thousand or fraction thereof, to and including $50,000.00. $50,000 to $100,000 $260.00 for the first $50,000.00 plus $4.00 for each additional thousand or fraction thereof, to and including $100,000.00. $100,000 to $500,000 $460.00 for the first $100,000.00 plus $3.00 for each additional thousand or fraction thereof, to and including $500,000.00. $500,000 and up $1,660.00 for the first $500,000.00 plus $2.00 for each additional thousand or fraction thereof. Moving fees. For the moving of any building or structure, the fee shall be $100.00 Demolition fees. For the demolition of any building or structures, the fee shall be: 0 up to 100,000 cu ft $50.00 100,000 cu ft and over $0.5011,000 cu ft Fee for Plan Checking. When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted by Section 104.2, a plan -checking fee shall be paid to the building official at the time of submitting plans and specifications for checking. Said plan -checking fee shall be equal to one-half of the building permit fee as set forth in 104.7. Such plan -checking fee is in addition to the building permit fee. Fee for Reinspection. If it becomes necessary to make a reinspection of a building or portion thereof,. the person, firth, corporation, individual or contractor who secured the original building permit shall pay reinspection fees as follows: a. For first re-inspection...................................................... $35.00 b. For each additional re -inspection thereafter..............................$50.00 Penalties. Where work for which a permit is required by this code is started or proceeded prior to obtaining said permit, the fees herein specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein. Subsection 108.3 Building permit valuations. Valuation estimates for the purpose for determining the valuation of residential construction and the subsequent permit fees, shall be set at a value of $50.00 per square foot. Square footage shall be the total square footage as calculated from the foundation plan. Commercial valuation shall be determined by occupancy, type and engineers bid estimate or the final total bid cost of construction. The applicant for a permit shall provide an estimated total permit value at time of application. Permit valuations shall include total value of work, including materials and labor, for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment and permanent systems. If, in the opinion of the building official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the building official. Final building permit valuation shall be set by the building official. 1612.3 Establishment of flood hazard areas. To establish flood hazard areas, the governing body shall adopt a flood hazard map and supporting data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the Federal Emergency Management Agency in an engineering report entitled "The Flood Insurance Study for City Of Cibolo," dated June 2, 1995, as amended or revised with the accompanying Flood Insurance Rate Map (FIRM) and Flood Boundary and Floodway Map (FBFM) and related supporting data including and all subsequent LOMARs along with any revisions thereto. The adopted flood hazard map and supporting data are hereby adopted by reference and declared to be part of this section. 3409.2 Applicability. Structures existing prior to October 1, 2001 in which there is work involving additions, alterations or changes of occupancy shall be made to conform to the requirements of this section or the - provisions of 3402 through 3406. Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the code official, or of a permit or certificate used under provisions of this code, shall be guilty of a Class C misdemeanor, punishable by a fine of not more than $500.00 dollars. Each day that a violation continues after due notice has been served shall be deemed a separate offense. Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $100.00 dollars or more than $500.00 dollars. Section 3. That Ordinance Number 507 of the City Of Cibolo entitled "AN ORDINANCE TO ADOPT VARIOUS STANDARD CODES RELATING TO INSPECTION ACTIVITIES OF CIBOLO AND ENFORCEMENT OF BUILDING PROVISIONS AS PROVIDED IN SAID CODES" and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. That nothing in this ordinance or in the International Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance. Section 5. That the City Secretary is hereby ordered and directed to cause this ordinance to be published. Section 6. That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force beginning October 1, 2001.
