ORD 519 1/23/2001ORDINANCE NUMBER �) Iq AN ORDINANCE ANNEXING THE HEREIN AFTER DESCRIBED TERRITORY TO THE CITY OF CIBOLO, TEXAS AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SUCH PROPERTY WITHIN THE CITY LIMITS. WHEREAS, a petition for annexation has been heretofore filed by Juanita Kardys Trust, being the owners of certain land in the extra -territorial jurisdiction of the City of Cibolo, Guadalupe County, Texas said land being described in paragraph 1 below, and WHEREAS, said petition in form and substance, fully complies with all of the provisions of Section 43.028, Local Government Code, V.A.T.S. and WHEREAS, said tract of land is contiguous and adjacent to the City of Cibolo, is not more than one-half mile in width and is vacant and without residents; and WHEREAS, the City Council is of the opinion that said petition should be granted and that such tract of land should be annexed to the City; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS 1. That the following described property, to wit: Being 70.3922 acres of land out of a certain 90.00 acre tract out of the Simon Cockrill survey No. 77, abstract No. 96, and the A.S. Lewis survey No. 78, abstract No. 216, City of Cibolo, as recorded in volume 1037 page 744-749 of the official records of Guadalupe County, Texas, and being more particularly described as follows: BEGINNING: At a %z" iron pin found for the most westerly comer of said 70.3922 acre tract, being the west comer of a 100.0 acre tract and also the west corner of the Simon Cockrill Survey No. 77 as recorded in Volume 214, Page 520 Deed Records of Guadalupe County, Texas; said point being located S 59°40'50" W 523.81 from the most northerly corner of Lot 58, Block 1, Thistle Creek, Unit 1, a subdivision recorded in Volume 5 page 32-A of the Plat Records of Guadalupe County, Texas; THENCE: N 60'06'11" E 942.13 feet along the northwest line of the Simon Cockrill Survey No.77, to a %z" iron pin found for an angle point, said line described above also being the southern boundary line of Deer Creek Subdivision; said comer also being the southwestern corner of a 3.26 acre tract conveyed to Mack and Juanita Kardys in Volume 491, Page 477, Deed Records of Guadalupe County, Texas, THENCE: Continuing along said northwest line of the Simon Cockrill Survey No. 77, N 60026'53" E 150.05 feet to a %z" iron pin found for a comer, said comer being the north comer of the above referenced 100 acre tract, which comer is also the west or northwest corner of a 100.0 acre tract conveyed to Hilmar Reiley by deed recorded in Volume 154, Page 528 of the Deed Records of Guadalupe County, Texas THENCE: Along the northeast line of said 100.0 acre tract, S 29'04'17" E 2831.98 feet to a %z" iron pin with "MBC" cap set for the east comer of the herein described tract, THENCE: S 62°49'00" W 1101.79 feet to a %s' iron pin with "MBC" cap set for the west comer of the herein described tract, THENCE: N 28° 15' 11" W 615.56 feet to a %2" iron pin found for an angle point, THENCE: N 28°57'05" W 1121.42 feet to a Y2" iron pin found for an angle point, THENCE: N 29'10'54" W 1043.93 feet to the POINT -OF -BEGINNING and containing 70.3922 acres of land. BE, and the same is hereby annexed into the City of Cibolo, and that the boundary lines of the City of Cibolo be and the same are hereby extended to include the above described territory within the city limits of the City of Cibolo, Texas, and the same shall hereafter be included within the territorial limits of said city, and the property owners and inhabitants thereof shall hereafter be entitled to all rights and privileges of other property owners and citizens of Cibolo, and shall be bound by the acts, ordinances and regulations of said City. 2. The City Secretary is hereby directed to file a certified copy of this ordinance together with a copy of said petition with the County Clerk of Guadalupe County, Texas. 3.
