Min CC 05/14/1996 �S /I MINUTES OF CITY COUNCIL MEETING THE CITY COUNCIL OF CIBOLO CONDUCTED A REGULARLY SCHEDULED MEETING ON TUESDAY,MAY 14,1996,AT 7:00 P.M.AT THE MUNICIPAL BUILDING,109 SOUTH MAIN STREET,CIBOLO,TEXAS.THE FOLLOWING WAS BE THE ORDER OF BUSINESS: I. CALL TO ORDER. Mayor Sam Bauder called the meeting to order at 7:00 P.M. II. ROLL CALL. Present were Mayor Bauder,and Councilmen Jeff Miller,Bob Glisar,Mark Buell and Chuck Ridge and Councilwoman Gail Douglas. Staff was represented by Public Works Director Keith Gilbreath,City Attorney Ron Flake and Interim City Administrator Rudy Farias. III. INVOCATION. Bob Glisar provided the invocation. IV. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge. V. CITIZENS TO BE HEARD. (LIMIT 3 MINUTES EACH) Thomas Ontiveroz spoke on behalf of his children and his children's friends limitations for playing in the roadway in front of his house. He addressed the concerns of potential juvenile crimes in the city due to the lack of juvenile supervision and play facilities. Concerned children would seek other means of entertainment due to having to take down basketball goal in city easement located in front of his house. Wants all other structures in city easements removed. Public Works Director Keith Gilbreath instructed Council and Mr. Ontiveroz that a city effort is being made to have all basketball goals removed from the city easements. VI. CONSENSUS ITEMS: A.APPROVAL OF MINUTES OF APRIL 23,1996 Jeff Miller moved for approval,seconded by Chuck Ridge. Approved. B. APPROVAL OF CHECK REGISTER FOR APRIL,1996 Jeff Miller moved for approval,seconded by Chuck Ridge. Approved. VII. CERTIFICATION OF MAY 4 ELECTION Mayor Bauder certified the election. VIII. A. SWEARING IN OF ELECTED OFFICIALS Judge Ernest Schlather swore in Councilmen Jeff Miller,Chuck Ridge,and Bob Glisar. B.ELECTION OF MAYOR PROTEM Jeff Miller elected Mayor Protem. IX. APPROVAL TO WAIVE PARK RENTAL FEES FOR CIBOLO CREEK SOFTBALL ASSOCIATION ON MAY 18 AND MAY 19, 1996 Discussion by council on the history of waving ball park fees for other organizations. History reflects none. Motion made by Mark Buell not to wave ball park fees. Motion died due to the lack of a second. Bob Glisar made a motion to wave park fees with the stipulation lights be paid for in advance. Seconded by Jeff Miller. Approved by all. X. SETTING OF DATES FOR PUBLIC HEARING TO DISCUSS ANNEXATION OF FIVE PROPERTIES ALONG FM 78 NEAR COUNTRY LANE Mayor Bauder set the dates for the two public hearings. The dates are May 28 and June 4, 1996 at 6:30 P.M. at the Cibolo City Hall. XI. RESOLUTION REDESIGNATING LOOP 539 AND FM 78 TO CORRECT ERROR OF TEXAS DEPARTMENT OF TRANSPORTATION Mark Buell moved for approval,seconded by Jeff Miller. Approved. XII. DECLARATION OF STAGE III OF THE DEMAND MANAGEMENT PLAN FOR WATER USE AND AMENDMENT OF RESTRICTIONS AS DESIRED BY COUNCIL Discussion by council on Cibolo being the only city in Stage III. Council addressed the issue of resident confusion for being in Stage III when San Antonio was in Stage H. Council decided to amend restrictions to reflect the City of San Antonio. Intent is to provide daily information to the residents of Cibolo through the San Antonio news media. Bob Glisar moved for approval to amend water restrictions to reflect San Antonio's,seconded by Mark Buell. Approved. Rudy Farias was given the authority to declare the various Stages. XIII. EXECUTIVE SESSION PURSUANT TO SECTION 551.074 OF THE TEXAS GOVERNMENT CODE CONCERNING DISCUSSIONS ON PERSONNEL MATTERS The council entered the session at 7:55 P.M. A DISCUSSION/ACTION ON INTERIM CITY ADMINISTRATOR CONTRACT Jeff Miller moved for approval on the interim city administrator contract,seconded by Bob Glisar. Approved. r., B. AUTHORIZATION TO SIGN PURCHASE ORDERS Mark Buell moved for approval authorizing Rudy Rene Farias to sign purchase orders,seconded by Bob Glisar. Approved. C. AUTHORIZATION TO SIGN CHECKS Mark Buell moved for approval authorizing Rudy Rene Farias to sign checks,seconded by Bob Glisar. Approved. D.DISCUSSION/ACTION REGARDING CONTRACTUAL ASSISTANCE DURING CITY ADMINISTRATOR LEAVE OF ABSENCE Mark Buell moved to approve contractual assistance during the city administrator's leave of absence if needed by Rudy Rene Farias,seconded by Bob Glisar. Approved. E.RECONVENE FOR NECESSARY ACTION The Mayor reconvened the open session at 8:08 P.M. Action taken is indicated above. XIV. COMMENTS BY COUNCIL MEMBERS Bob Glisar commented this years sausage supper was real nice. Mark Buell agreed with Bob and indicated it was probably the best sausage super the Cibolo VFD has had. Also,Cibolofest will have its first meeting June 10, 1996 at 7:00 P.M. Rudy Farias will update the committee on the park grant. Cibolofest golf tournament is scheduled for June 29, 1996. Chuck Ridge commented on the Habitat Conservation Plan. Also advised Lake Dunlap will be sprayed. Jeff Miller also discussed the Habitat Conservation Plan and recommended Rudy Farias speak with David Davenport about the plan. XV. COMMENTS BY STAFF Keith Gilbreath indicated the plans from Ed Ford had not been received and Cibolo's ETJ now extends to IH 10. Ron Flake said he will be out of town on May 28, 1996. Rudy Farias said he will continue to work at making Cibolo the pride of the Northeast Quadrant and thanked council for the opportunity to serve the residents and staff of the City of Cibolo. XVI. COMMENTS BY MAYOR Mayor Bauder commented on the Sausage Supper auction. Said it was the best auction the Cibolo VFD has had and this years crowd was the largest seen at the Sausage Supper. XVII.
