Min CC 05/28/1996 - r MINUTES OF CITY COUNCIL MEETING THE CITY COUNCIL OF CIBOLO CONDUCTED A REGULARLY SCHEDULED MEETING ON TUESDAY,MAY 28,1996 AT 7:00 P.M.AT THE MUNICIPAL BUILDING,109 SOUTH MAIN STREET,CIBOLO,TEXAS.THE FOLLOWING WAS THE ORDER OF BUSINESS: I. CALL TO ORDER. Mayor Sam Bauder called the meeting to order at 7:00 P.M. II. ROLL CALL. Present were Mayor Bauder,and Councilmen Jeff Miller,Bob Glisar,Mark Buell and Councilwoman Gail Douglas. Staff was represented by Public Works Director Keith Gilbreath,Director of Public Safety Wes Suiter and Interim City Administrator Rudy R.Farias. III. INVOCATION. Bob Glisar provided the invocation at the 6:30 p.m.Public Hearing. Therefore,the invocation was not repeated. IV. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge conducted at the 6:30 p.m.Public Hearing. Therefore,the pledge was not repeated. V. CITIZENS TO BE HEARD. (LIMIT 3 MINUTES EACH) None present. V1. CONSENSUS ITEMS: A. APPROVAL OF MINUTES OF MAY 14,1996 Jeff Miller moved for approval,seconded by Mark Buell. Approved. VII. ORDINANCE AMENDING THE WATER RESTRICTIONS DEMAND MANAGEMENT PLAN REDUCTION MEASURES TO REFLECT THOSE OF THE CITY OF SAN ANTONIO Motion tabled until Stage IV measures are published by San Antonio Water Systems and adopted by City of San Antonio. Jeff Miller moved to table,seconded by Mark Buell. Approved. VIII. RESOLUTION ORDERING PUBLIC HEARINGS ON ANNEXATION OF PROPERTY BELONGING TO MARY E. CAPPERINO Bob Glisar moved for approval,seconded by Mark Buell. Approved. IX. RESOLUTION ORDERING PUBLIC HEARINGS ON ANNEXATION OF PROPERTY BELONGING TO BILLY RAY HEIMAN AND BARBARA ANN HEIMAN Bob Glisar moved for approval,seconded by Gail Douglas. Approved. X. RESOLUTION ORDERING PUBLIC HEARINGS ON ANNEXATION OF PROPERTY BELONGING TO DANIEL B.NIEMIETZ,JR. Bob Glisar moved for approval,seconded by Jeff Miller. Approved. M. RESOLUTION ORDERING PUBLIC HEARINGS ON ANNEXATION OF PROPERTY BELONGING TO JOSEPH R NIEMIETZ AND DIANE NIEMIETZ Bob Glisar moved for approval,seconded by Jeff Miller. Approved. XII. RESOLUTION ORDERING PUBLIC HEARINGS ON ANNEXATION OF PROPERTY BELONGING TO FERDINAND L.NIEMIETZ AND MARTHA A. NIEMIETZ Bob Glisar moved for approval,seconded by Jeff Miller. Approved. XIII. PRESENTATION FROM DAVID DAVENPORT REGARDING HABITAT CONSERVATION PLAN GUADALUPE RUN OF RIVER RIGHTS The Guadalupe run of river rights is a plan to convert individual irrigation rights on the Guadalupe River to water utilities. The Habitat Conservation Plan is intended to encompass a number of water utilities which will file a permit request with U.S.Fish and Wildlife. This permit if granted,may allow the same pumpage from the Edward's Aquifer of each participating water utility and help avoid a possible law suite from U.S.Fish and Wildlife. Cost of the plan will be based on the number of water meters for each participating water utility. XIV. COMMENTS BY COUNCIL MEMBERS Jeff Miller said we need to keep Rudy involved with the Habit Conservation Plan. Also said he will be out of town from June 6th- 12th. Mark Buell commented we cannot afford not to look into the Habitat Conservation Plan. He also commended the residents for decreasing water usage. Bob Glisar commented on the completion of the F.M. 1103 curve. XV. COMMENTS BY STAFF Wes Suiter informed council that the second policeman requested in the Fastcops Grant was funded. Keith Gilbreath said on June 17th,Deer Creek 2-2 will compact subgrade. Also,Robert Arenas fixed the fire-hydrant leak It took 3.5 hours to repair. XVI. COMMENTS BY MAYOR Mayor Bauder expressed a need for a Habitat Conservation Plan. He said we need to watch what other water utilities will do in terms of participating in the Habitat Conservation Plan. XVII. ADJOURNMENT Bob Glisar made the motion.
