ORD 471 6/25/1996ORDINANCE NUMBER 471 AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF CIBOLO, TEXAS AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SUCH PROPERTY WITHIN THE CITY LIMITS. WHEREAS, a petition for annexation has been heretofore filed by Ferdinand L. Niemietz and Martha A Niemietz being the owners of certain land in the extra -territorial jurisdiction of the City of Cibolo, Guadalupe County, Texas, said land being described in Paragraph 1 below, and WHEREAS, said petition is proper in form and substance and fully complies with all of the provisions of Art. 9748, V.A.T.S.; and WHEREAS, two public hearings have been held; and WHEREAS, said tract of land is contiguous and adjacent to the City of Cibolo, and is not more than one- half mile in width; and WHEREAS, the City Council is of the opinion that said petition should be granted and that said tract of land should be annexed to the City; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: 1. That the following described property, to wit: Being 3.000 acres of land more or less out of the Geronimo Leal Survey No. 85, Abstract No. 210, Guadalupe County, Texas, out of that certain called 28.16 acre tract described in Volume 281, Page 575 of the Deed of Records of Guadalupe County, Texas (hereinafter referred to as the Parent Tract); Said 3.000 acre parcel being more particularly described as follows: BEGINNING at a 5/8 inch iron pipe found for the most southerly corner of the Parent Tract and the most easterly corner of that certain called 22.0 acre tract described in Volume 615, Page 243 of the Official Records of Guadalupe County, Texas being located on the common line of the Parent Tract and that certain called 52.2 acre tract recorded in Volume 322, Page 366 of the Deed Records of Guadalupe County, Texas; THENCE with the common line of the Parent Tract and said 52.2 acre tract, N. 600 00' 00" East, a distance of 408.41 feet to a 1/2 inch iron rod set for the most southerly comer and Point of Beginning of this parcel; THENCE across the Parent Tract, N. 290 56' 22" West, a distance of 883.88 feet to a 1/2 inch iron rod set on the southeasterly right-of-way line of F.M. 78 for the most westerly comer of this parcel; THENCE with said right-of-way line, N. 84° 47' 55" East, a distance 169.61 feet to a 1/2 inch iron rod set for the most northerly corner of this parcel and the most westerly comer of that certain called 3.000 acre parcel described in Volume 540, Page 337 of the Deed Records of Guadalupe County, Texas; THENCE leaving said right-of-way line and with the common line of this parcel and said 3.000 acre parcel described in Volume 540, Page 337, S. 29° 56' 22" East, a distance of 812.74 feet to a 1/2 inch iron rod set for the most easterly comer of this parcel, being located in the common line of the Parent Tract and the aforementioned 52.2 acre tract; 4'7( TBENCE with the common line of the Parent Tract and said 52.2 acre tract, S. 60° 00' 00" West (basis of bearings), a distance of 154.05 feet to the Point of Beginning and containing 3.000 acres of land. BE, and the same is hereby annexed to the City of Cibolo, and that the boundary lines of the City of Cibolo be, and the same are hereby extended to include the above described territory within the city limits of the City of Cibolo, Texas, and the same shall hereafter be included within the territorial limits of said city, and the property owners and inhabitants thereof shall hereafter be entitled to all rights and privileges of other property owners and citizens of Cibolo, and shall be bound by the acts, ordinances and regulations of said City. 2. The City Secretary is hereby directed to file a certified copy of this ordinance with the County Clerk of Guadalupe County, Texas. 3. Niemietz and Martha A Niemietz Rt. I Box 5C Cibolo, Texas 78108 Subject: Annexation Service Plan Dear Ferdinand L. Niemietz and Martha A. Niemietz: Upon completion of the annexation of 3.000 acres of land owned by Ferdinand L. Niemietz and Martha A. Niemietz which both of you have petitioned to the City for annexation, the City of Cibolo hereby provides the following service plan for the land being annexed into the Corporate Limits of the City of Cibolo, Texas. 1. Police: Radio responses to calls, and other equipment, will be provided on and after the effective date of annexation. Traffic signs, street markers, and other traffic control devises will be installed as the need thereof is established by appropriate study and traffic requirements. 2. Fire: Fire protection by the present personnel and equipment of the fire fighting force of the Cibolo Volunteer Fire Department, within the limitations of the available water, will be provided on and after the effective date of annexation. 3. Water: Water for domestic, commercial and industrial use will be provided at city rates, from existing city lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with utility extension policies of the City. 4. Sewer: Wastewater usage for domestic, commercial and industrial use will be provided at city rates, from existing water lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with the utility extension policies of the City. 5. Inspection Services: Any inspection services now provided by the City (building, plumbing, electrical, etc.), will be available in the annexation area on and after the date of annexation. 6. Planning and Zoning: Planning and Zoning jurisdiction of the City will extend to the annexed area on and after the effective date of annexation. 7. Street Lighting Street lighting will be installed in substantially developed area(s) in accordance with established policies of the City and within the capability of the Guadalupe Valley Electric Co-op. 8. Street Name Signs: Street name signs, where required, will be installed. 9. Miscellaneous: All recreational facilities provided by the City will become available to all residents of the land being annexed on and after the effective date of annexation. Charles A.
