ORD 468 6/25/1996ORDINANCE NUMBER 46 S AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF CIBOLO, TEXAS AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SUCH PROPERTY WITHIN THE CITY LRvfrrS. WHEREAS, a petition for annexation has been heretofore filed by Billy Ray Heiman and Barbara Ann Heiman being the owners of certain land in the extra -territorial jurisdiction of the City of Cibolo, Guadalupe County, Texas, said land being described in Paragraph 1 below, and WHEREAS, said petition is proper in foam and substance and fully complies with all of the provisions of Art. 974g, V.A.T.S.; and WHEREAS, two public hearings have been held; and WHEREAS, said tract of land is contiguous and adjacent to the City of Cibolo, and is not more than one- half mile in width; and WHEREAS, the City Council is of the opinion that said petition should be granted and that said tract of land should be annexed to the City; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: 1. That the following described property, to wit: Being 3.000 acres of land more or less out of the Geronimo Leal Survey No. 85, Abstract No. 210, Guadalupe County, Texas, out of that certain called 28.16 acre tract described in Volume 281, Page 575 of the Deed Records of Guadalupe County, Texas (hereinafter referred to as the Parent Tract); Said 3.000 acre parcel being more particularly described as follows: BEGINNING at a 1/2 inch iron rod set on the southeasterly right-of-way line of F.M. 78 for the most westerly comer of the Parent Tract, the most northerly comer of that certain called 1.01 acre parcel described in Volume 897, Page 19 of the Official Records of Guadalupe County, Texas and for the most westerly corner and Point of Beginning of this parcel; THENCE with said right-of-way line, N. 84° 47' 55" East, a distance of 233.70 feet to a 3/4 inch iron pipe found for an angle point and S. 89° 5 P 19" East, a distance of 31.07 feet to a 1/2 inch iron rod set for the most northerly comer of this parcel; THENCE leaving said right-of-way line and into the Parent Tract, S. 29° 56' 22" East, a distance of 483.10 feet to a 1/2 inch iron rod set for the most easterly corner of this parcel; THENCE S. 600 00' 00" West, a distance of 243.26 feet to a 1/2 inch iron rod set on the common line of the Parent Tract and that certain called 22.0 acre tract described in Volume 615, Page 243 of the Official Records of Guadalupe County, Texas, for the most southerly comer of this parcel; THENCE with the common line of the Parent tract with a portion of said 22.0 acre tract and the aforementioned 1.01 acre parcel, N. 29° 32' 36" West, a distance of 596.74 feet to the place of beginning, and containing 3.000 acres of land. BE, and the same is hereby annexed to the City of Cibolo,.and that the boundary lines of the City of Cibolo be, and the same are hereby extended to include the above described territory within the city limits of the City of Cibolo, Texas, and the same shall hereafter be included within the territorial limits of said '4G 8 city, and the property owners and inhabitants thereof shall hereafter be entitled to all rights and privileges of other property owners and citizens of Cibolo, and shall be bound by the acts, ordinances and regulations of said City. 2. The City Secretary is hereby directed to file a certified copy of this ordinance with the County Clerk of Guadalupe County, Texas. 3. ATTEST MAYOR C" ✓ a CITY SECRETARY Billy Ray Heiman and Barbara Ann Heiman Rt. 1 Box 5, Hwy 78 Cibolo Guadalupe County, Texas 78108 Subject: Annexation Service Plan Dear Mr. and Mrs. Heiman: Upon completion of the annexation of 3.000 acres of land owned by Billy Ray Heiman and Barbara Ann Heiman which both of you have petitioned to the City for annexation, the City of Cibolo hereby provides the following service plan for the land being annexed into the Corporate Limits of the City of Cibolo, Texas. 1. Police: Radio responses to calls, and other equipment, will be provided on and after the effective date of annexation. Traffic signs, street markers, and other traffic control devises will be installed as the need thereof is established by appropriate study and traffic requirements. 2. Fire: Fire protection by the present personnel and equipment of the fire fighting force of the Cibolo Volunteer Fire Department, within the limitations of the available water, will be provided on and after the effective date of annexation. 3. Water: Water for domestic, commercial and industrial use will be provided at city rates, from existing city lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with utility extension policies of the City. 4. Sewer. Wastewater usage for domestic, commercial and industrial use will be provided at city rates, from existing water lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with the utility extension policies of the City. 5. Inspection Services: Any inspection services now provided by the City (building, plumbing, electrical, etc.), will be available in the annexation area on and after the date of annexation. 6. Planning and Zoning: Planning and Zoning jurisdiction of the City will extend to the annexed area on and after the effective date of annexation. 7. Street Lighting Street lighting will be installed in substantially developed area(s) in accordance with established policies of the City and within the capability of the Guadalupe Valley Electric Co-op. 8. Street Name Signs: Street name signs, where required, will be installed. 9. Miscellaneous: All recreational facilities provided by the City will become available to all residents of the land being annexed on and after the effective date of annexation. Charles A.
