ORD 467 6/25/1996ORDINANCE NUMBER 467 AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRUORY TO THE CITY OF CIBOLO, TEXAS AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SUCH PROPERTY WITHIN THE CITY LRvHTS. WHEREAS, a petition for annexation has been heretofore filed by Mary E. Capperino being the owner of certain land in the extra -territorial jurisdiction of the City of Cibolo, Guadalupe County, Texas, said land being described in Paragraph 1 below, and WHEREAS, said petition is proper in form and substance and fully complies with all of the provisions of Art. 9748, V.A.T.S.; and WHEREAS, two public hearings have been held; and WHEREAS, said tract of land is contiguous and adjacent to the City of Cibolo, and is not more than one- half mile in width; and WHEREAS, the City Council is of the opinion that said petition should be granted and that said tract of land should be annexed to the City; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: 1. That the following described property, to wit: Being 1.01 acres of land more or less out of the Gemnimo Leal original Survey No. 83, Guadalupe County, Texas and being the eastern portion of that 2 acres conveyed to August Haecker by Gust. Vordenbaumen and wife by deed dated November 5, 1928, and recorded in said County in Deed Record Book 104, pages 64 and 65, and is the identical property conveyed to us by Alwin Haecker and others, and more particularly described as follows: BEGINNING at a brass disk found for the northeast corner of said 2 acres tract a stake set in the fence on south boundary of the San Antonio -Houston highway, at the intersection of a 30 foot road running in a westerly direction from said highway, said 30 foot road running to the Old Seguin-Cibolo Road; THENCE South 30 degrees east with the east line of said 2 acres 210 feet to a fence comer for the southeast corner thereof; THENCE South 60 degrees west 210 feet to an angle point for the southeast comer of a one acre tract sold by August Haeker to Catation Alvarado on December 17, 1934, by deed recorded in Deed Book 153; pages 505-506; THENCE North 30 degrees west with the east line thereof 210 feet to an iron pin found for the north west line of said 2 acres; THENCE North 60 degrees east with said land or road and the highway 210 feet to the place of beginning, containing 1.01 acres (44,100) square feet) of land. BE, and the same is hereby annexed to the City of Cibolo, and that the boundary lines of the City of Cibolo be, and the same are hereby extended to include the above described territory within the city limits of the City of Cibolo, Texas, and the same shall hereafter be included within the territorial limits of said city, and the property owners and inhabitants thereof shall hereafter be entitled to all rights and privileges of other property owners and citizens of Cibolo, and shall be bound by the acts, ordinances and regulations of said City. 2. The City Secretary is hereby directed to file a certified copy of this ordinance with the County Clerk of Guadalupe County, Texas. 3. Capperino Rt. 1 Box 12 Cibolo, Texas 78108 Subject: Annexation Service Plan Dear Ms. Capperino: Upon completion of the annexation of 1.01 acres of land owned by MaryE. Capperino which you have petitioned to the City for annexation, the City of Cibolo hereby provides the following service plan for the land being annexed into the Corporate Limits of the City of Cibolo, Texas. 1. Police: Radio responses to calls, and other equipment, will be provided on and after the effective date of annexation. Traffic signs, street markers, and other traffic control devises will be installed as the need thereof is established by appropriate study and traffic requirements. 2. Fire: Fire protection by the present personnel and equipment of the fire fighting force of the Cibolo Volunteer Fire Department, within the limitations of the available water, will be provided on and after the effective date of annexation. 3. Water: Water for domestic, commercial and industrial use will be provided at city rates, from existing city lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with utility extension policies of the City. 4. Sewer. Wastewater usage for domestic, commercial and industrial use will be provided at city rates, from existing water lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with the utility extension policies of the City. 5. Inspection Services: Any inspection services now provided by the City (building, plumbing, electrical, etc.), will be available in the annexation area on and after the date of annexation. 6. Planning and Zoning: Planning and Zoning jurisdiction of the City will extend to the annexed area on and after the effective date of annexation. 7. 'Street Lighting: Street lighting will be installed in substantially developed area(s) in accordance with established policies of the City and within the capability of the Guadalupe Valley Electric Co-op. 8. Street Name Signs: Street name signs, where required, will be installed. 9. Miscellaneous: All recreational facilities provided by the City will become available to all residents of the land being annexed on and after the effective date of annexation. Charles A.
