ORD 447 8/9/1994CITY OF CIBOLO AN ORDINANCE #447 AN ORDINANCE APPROVING THE PARK LAND DEDICATION OUT OF DEER CREEK SUBDIVISION WITHIN THE CORPORATE LIMITS OF THE CITY OF CIBOLO, TEXAS THE CITY COUNCIL OF THE CITY OF CIBOLO MAKES THE FOLLOWING FINDINGS: 1. Ownership Interests. Cibolo Deer Creek Properties, Ltd. owns the property described as a 190.7846 acre tract of land out of 198.114 acres out of the Doroteo Hernandez Survey No. 76, Abstract No. 154, City of Cibolo, referenced in certain deeds recorded in Volume 1080, Page 897, and Volume 1080, Page 892 of the Deed Records of Guadalupe County (the "Property"). 2. Dedication of Park Land. Cibolo Deer Creek Properties, Ltd. proposes to dedicate a portion of the Property as park land according to the Park Land Dedication Agreement by and between The City of Cibolo and Cibolo Deer Creek Properties, Ltd. 3. lmnosition of Assessments. Cibolo Deer Creek Properties, Ltd. proposes to impose an assessment against each developed lot in the Property according to the Park Land Dedication Agreement by and between The City of Cibolo and Cibolo Deer Creek Properties, Ltd. 4. Public Interest. It is for the benefit of the public that the park land dedication and the method and manner of property assessments benefitting the dedicated park land as contemplated in the Park Land Declaration Agreement should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION 1. The Park Land Dedication Agreement by and between The City of Cibolo and Cibolo Deer Creek Properties, Ltd. is hereby approved and accepted in its entirety. Compliance by Cibolo Deer Creek Properties, Ltd. with the Park Land Dedication Agreement shall fully satisfy the dedication of park land requirements for the Property in accordance with the Subdivision Ordinance of The City of Cibolo. SECTION 2. The Mayor of The City of Cibolo is hereby authorized, empowered and directed to execute the Park Land Dedication Agreement as of the effective date of this ordinance.
