AN ORDINANCE AMENDING ORDINANCE #385 (LAND SUBDIVISION ORDINANCE)
CONCERNING FEES ASSESSED FOR PRELIMINARY FILING OF PLAT,
VARIANCES TO REQUIREMENTS OF THE ZONING ORDINANCE OR OTHER CITY
BUILDING REQUIREMENTS, AND CONTRIBUTIONS OF CASH IN LIEU OF PARK
LAND.
WHEREAS, the City of Cibolo seeks to charge fair and equitable
fees for its services; and
WHEREAS, such fees must be adjusted periodically to reflect
changes in costs to the City of Cibolo; and
WHEREAS, cash assessments to the Park Fund in lieu of dedication
of land, fees for Preliminary Platting of Subdivisions, and fees
for processing of requests for variances from the Zoning
Ordinance or other building requirements have not been adjusted
since November 1986; and
WHEREAS, current property development activity is requiring a
considerable amount of staff time and effort; and
WHEREAS, the City Council of Cibolo seeks to recover its expenses
by amending Section V, subsection A, paragraph 9 "Filing Fees";
Section VIII, subsection Dedication of Park Lands or Payment of
Fees On Lieu Thereof, paragraph 3A, "Cash Contributions in lieu
of park land"; and Section XI, subsection Variances;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF CIBOLO,
TEXAS:
SECTION V
Section V, subsection A., paragraph 9 will be revised to read as
follows:
A. PRELIMINARY PLAT
9. FILING FEES: $100.00 per subdivision PLAT, plus $5.00 per
residential lot; $20 per acre for any other use (such as
commercial or industrial) at the time of filing.

SECTION VIII
Section VIII, subsection Dedication of Park Lands or Payment of
Fees On Lieu Thereof, paragraph 3A. Cash Contribution in lieu of
park land, will be revised to read as follows:
The City Administrator or his designated represented
representative may recommend to the Planning and Zoning
Commission that a cash contribution to the Park Fund may be made
in lieu of park land.
The Planning and Zoning Commission may recommend to the City
Council that the developers of all major and minor subdivisions
shall meet the suggested park land dedication guidelines with a
cash contribution at the rate of two hundred dollars ($200.00)
per dwelling unit for single family; one hundred seventy-five
dollars ($175.00) per dwelling for two-family; and one hundred
fifty dollars ($150.00) per dwelling unit for multi -family (more
than two).
SECTION XI
Section XI, VARIANCES will be revised to read as follows:
VARIANCES
When a subdivider can show that a provision of these regulations
would cause unnecessary hardship if strictly adhered to and
where, because of some condition peculiar to the site, in the
opinion of the City Council, a departure may be made without
destroying the intent of such provisions, the City Council may
authorize a variance.
FEE FOR ANY SUCH VARIANCE REQUESTED SHALL BE $100.00 FOR EACH
SEPARATE VARIANCE.
