Min CC 08/27/1996 MINUTES OF CITY COUNCIL MEETING THE CITY COUNCIL OF CIBOLO CONDUCTED A REGULARLY SCHEDULED MEETING ON TUESDAY,AUGUST 27, 1996 AT 7:00 P.M.AT THE MUNICIPAL BUILDING,109 SOUTH MAIN STREET,CIBOLO,TEXAS.THE FOLLOWING WAS THE ORDER OF BUSINESS: I. CALL TO ORDER. Mayor Sam Bauder called the meeting to order at 7:00 P.M. U. ROLL CALL. Present were Mayor Bauder,and Councilmen Jeff Miller,Bob Glisar,Mark Buell and Chuck Ridge and Councilwoman Gail Douglas. Staff was represented by Public Works Director Keith Gilbreath,City Administrator Chuck Balcar and intern Rudy Farias. in. INVOCATION. Bob Glisar provided the invocation. IV. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge. V. CITIZENS TO BE HEARD. (LIMIT 3 MINUTES EACH) None. VI. CONSENSUS ITEMS: A.APPROVAL OF MINUTES OF AUGUST 13,1996 Mr.Miller moved for approval,seconded by Mr.Buell. Approved. VII. PRESENTATION FROM MARK VAUGHAN CONCERNING ALTERNATIVES TO CITY REQUIREMENTS FOR CURB AND GUTTER Mark Vaughn brought in pictures from Garden Ridge Estates. Stated the pictured roads are 22 feet wide with ribbon curbs 18 inches wide and 6 inches deep. City Engineer,Mr.Ford, said the City has established standards. The curbs provide for a drainage way and provide pedestrian protection from vehicles. Stated,if allowed,future problems for the City include cleaning drainage easements and having standing water in driveways. Said ribbon curbs are not equal to curbs in the Subdivision Ordinance. Mayor asked if it would hold the road together. Mr.Ford stated it would but the protection of pedestrians needs to be considered. Ms.Douglas asked if sidewalks where to be included. Mr Miller and Mr.Ford said the ordinance calls for sidewalks. w= Mr. Vaughn stated he has never seen a one house per acre subdivision with curb,gutters,and sidewalks. Said he is trying to develop with a rural setting. Feels we need an ordinance for rural development in addition to the one we have. Said with one house per acre he cannot afford to do this. Mr.Ford said the cost difference is nominal. Both types of curbs come in about the same price. Mr. Vaughn stated the cost exception is the additional engineering fees to shot the streets. It is an additional $10,000-$15,000 cost according to his engineer Craig Holme. Mr.Miller said the roads in Royal Oaks Acres are already cracking and we need curbs to protect the roads. Mr.Vaughn said he is trying to meet the city half way. He does not want to put in curbs and sidewalks. Mr.Balcar asked if the plat had been re drawn showing the septic systems out of the floodway. Mr.Vaughn said no,the lateral lines will be placed in the front of these homes and the second bridge would be built to the 100 year floodway. Mr.Buell asked Mr.Ford if the ribbon curb would protect the streets. Mr.Ford said yes but that is not what the city ordinance requires. Mr.Miller commented there are no sidewalks on Buffalo Trail and the residents are complaining. Ms.Douglas asked if we needed one acre tracts with curb and gutters. The Mayor said,number one we want a curb to protect the road. Sidewalks are still up for debate. Mr.Miller agreed with Mr.Ford and said we need curbs to protect pedestrians and channel water. Mr. Glisar said curbs protect subgrade. Mr Vaghn said he proposes to have another fifty acres and begin developing towards Town Creek. Went on to say Cibolo is a joke when it comes to sidewalks. Asked where are the sidewalks? Mayor suggested having a ribbon curb,followed by an open ditch,then a sidewalk. Mr. Gilbreath said the slope would have to be limited to prevent erosion. The Mayor asked for final comments from the council. Ms.Douglas said she liked the ribbon curb. Mr.Miller wanted curb and gutters. Mr.Ridge wants curb,gutters,and sidewalks. Mr. Glisar said the ribbon curb is fine with sidewalks. Mr.Buell said the ribbon curb with sidewalks is fine. Mr Borgfeld in the audience was allowed comment. He stated he likes large lots and does not care for high density,but if there is high density the infrastructure needs to be put in. Mr.Ford concluded by stating he needs a complete set of plans with the bridge,etc.before the plat is resubmitted. VIII. REQUEST FOR A VARIANCE BY KENNETH SELF TO PLACE A MODULAR PRE- CONSTRUCTED HOME ON ACREAGE ON WIEDERSTEIN ROAD(OR TO ALLOW TEMPORARY PLACEMENT OF A MOBILE HOME WHILE A HOME IS CONSTRUCTED) Kenneth Self said the land is a three acre lot. The modular home will be placed 140 feet off the road. It will not be seen,easily from the road. Ms.Douglas made a motion to approve the variance for a modular home and tabled the request for a mobile home. Mr.Miller seconded. Approved. IX. ADOPTION OF THE FY 1996-97 ANNUAL CITY OF CIBOLO BUDGET Mr.Balcar summarized the budget and stated the tax rate is.3232 cents. Mr.Buell motioned for approval and seconded by Mr. Glisar. Approved. X. ADOPTION OF A PROPERTY TAX RATE FOR FY 1996-97 Mr.Farias read the property tax rate for the record. Mr. Glisar motioned for approval and seconded by Mr.Buell. Approved. M. COMMENTS BY COUNCIL MEMBERS Ms.Douglas commented on the beauty of Deer Creek Section II Phase II. Mr.Miller commented on the need to have places(sidewalks)to walk,run, and push baby buggies. Mr.Buell asked if the Chief of Police was going to introduce the new reserve officer. Mr.Balcar stated the Chief was at a training school. XII. COMMENTS BY STAFF Mr. Gilbreath commented on sidewalks along the Parkway in Deer Creek Section II Phase II;Where do we locate them, along the curb or down at ground level? Stated the developer will build the sidewalks but if located in the"greenbelt"the HOA would maintain them. Mr Gilbreath also stated the seeding of the drainage in Deer Creek Section II Phase II had been waved due to concerns involving whether conditions. Stated with the next heavy down pour the seeds will wash away. Also,Mr. Gilbreath wants to bond out the sidewalks and signs in order to approve Deer Creek Section II Phase II. XIII.
