Min CC 06/24/1997 MINUTES OF CITY COUNCIL MEETING THE CITY COUNCIL OF CIBOLO CONDUCTED A REGULARLY SCHEDULED MEETING ON TUESDAY,6/24/97,AT 7:00 P.M.AT THE MUNICIPAL BUILDING,109 SOUTH MAIN STREET,CIBOLO,TEXAS.THE FOLLOWING WAS THE ORDER OF BUSINESS: I. CALL TO ORDER. Mayor Sam Bauder called the meeting to order at 7:00 PM. Il. ROLL CALL. Present were Mayor Bauder,and Councilmen Jeff Miller,Bob Glisar,Albert Johnson,and Chuck Ridge and Councilwoman Gail Douglas. Staff was represented by Chief of Police Wes Suiter,Public Works Director Keith Gilbreath,City Attorney Ron Flake and City Administrator Tom Newman. III. INVOCATION. Bob Glisar provided the invocation. IV. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge. V. CITIZENS TO BE HEARD. (LIMIT 3 MINUTES EACH) 1. Mr.Brent Free,Attorney,representing Mr.Roy Dawkins,owner of Shady Meadows, expressed concern over possibility of property condemnation due to flooding. Water is on,but electricity is needed for occupants to clean up. Mr.Dawkins will address health concerns,but wants to ensure his own rights. 2. Ms. Susan Schofield,declined to speak. 3. Ms.M uji Jeffreys,representing Parks and Recreation Commission,informed Council the Golf Tourney had been postponed. It is rescheduled for August 9, 1997. 4. Mr.Martin Guzman inquired into what to expect in regards to the trailer park. 5. Mayor Bauder informed those present that there was no agenda item in that regard,and there would be no action taken at this meeting. He called on City Attorney,Mr.Ron Flake,to address the issue. 6. Mr.Flake assured all present that the City is inspecting the properties at Shady Meadows to ensure the health and safety of residents. If a hazard is identified,a home may have to be condemned,and tagged until it is made safe. Red Cross assistance and relief information is available in Schertz. 7. An unnamed citizen complained of fumes due to the flood. 8. An unnamed citizen complained that their residence was unlivable. 9. An unnamed citizen inquired if Mr.Dawkins could move her home without her consent. 10. An unnamed citizen complained of ongoing electrical fire hazard in her house. 1.� VI. CONSENSUS ITEMS: A. APPROVAL OF MINUTES OF JUNE 10,1997 MEETING Jeff Miller motioned for approval. Seconded by Chuck Ridge. Bert Johnson recommended correction of two typographical errors in the minutes . Approved as corrected. B. APPROVAL OF MINUTES OF JUNE 16,1997 MEETING Jeff Miller motioned for approval. Seconded by Chuck Ridge. Bert Johnson recommended correction of two typographical errors in the minutes. Approved as corrected. VII. DISCUSSION/ACTION ON AN ORDINANCE SETTING STOP INTERSECTION FOR THISTLE CREEK,UNIT 4 Chief of Police Wes Suiter briefly explained the reason for the ordinance. Jeff Miller motioned to approve the ordinance. Seconded by Bob Glisar. Approved. VIII. DISCUSSION/ACTION ON AN ORDINANCE SETTING SPEED LIMITS FOR THISTLE CREEK,UNIT 4 Jeff Miller motioned to approve the ordinance. Seconded by Bert Johnson. Approved. IX. DISCUSSION/ACTION ON BILL FOR DIETZ RD. SEWER LINE BREAK REPAIR WORK DONE BY SCHERTZ In response to a question by Jeff Miller,Keith Gilbreath and Mayor Bauder provided a brief explanation of the original situation. Schertz billed the City for$6015.53,half the total project cost,in June 1987. The City only felt obligated for$1555.50--half of the contractor's cost,and that was paid to Schertz in August, 1987. The current bill received from Schertz is for the remaining$4460.03. Council discussed the various perceptions on the issue. Ron Flake recommended that the City Administrator research the issue further,and contact Schertz Bob Glisar motioned to table item until Tom Newman can do so. Seconded by Gail Douglas. Approved. X. DISCUSSION/ACTION ON REIMBURSEMENT OF OVERPAID PERMIT FEES BY BUFFINGTON HOMES Keith Gilbreath explained that Buffington Homes had paid fees on the selling price of the homes instead of on the building cost. Total reimbursement owed is$11,237.02. Bob Glisar motioned to reimburse Buffington. Seconded by Chuck Ridge. Approved. XI. DISCUSSION/ACTION ON BILLING OF CUSTOMER FOR SEWER CLEANOUT Keith Gilbreath informed Council that customer had called for the City to clean sewer blockage felt to be in City property. Subsequent repair found blockage to be well within customer property. Bob Glisar motioned to bill customer with letter of explanation. Seconded by Chuck Ridge. Approved. XII. DISCUSSION/ACTION ON DEMOLITION OF STRUCTURE IN PARK Keith Gilbreath presented the scope of work to be included in contract to have building removed at no cost to City other than minor labor. Jeff Miller motioned to approve removal subject to amendment of scope of work,and contract developed by City Attorney. Seconded by Bob Glisar. Approved. XIII DISCUSSION/ACTION ON PURCHASE OF SEWER JET MACHINE Discussion of cost and availability of machines was inconclusive. Jeff Miller motioned to table item pending more detailed information. Seconded by Bert Johnson. Approved. XIV. DISCUSSION/ACTION ON COMMUNICATIONS SYSTEMS Wes Suiter explained need for better communications,and cost of upgrading system. Bob Glisar motioned to approve. Seconded by Jeff Miller. Approved. XV. COMMENTS BY COUNCIL MEMBERS Gail Douglas expressed sympathy for flood victims,and informed them of the Schertz disaster fund and Red Cross assistance. Bert Johnson inquired on status of Dietz Rd. ownership. Keith Gilbreath stated he had received no response to his attempt to get on the County agenda. He and Jeff Miller will attend the June 30 meeting. Jeff Miller commented on effect the rain had on the Clemen's 15-yr reunion. XVI. COMMENTS BY STAFF Tom Newman inquired if any Council members would be interested in New Elected Official Training. Keith Gilbreath reiterated City and resident responsibilities regarding condemnation of property for health and safety reasons. An unnamed citizen commended City workers for their efforts and service. Wes Suiter updated Council on employee application process. Ron Flake described the agreement to resolve the flood plain difficulty in Deer Creek by the builder indemnifying the City until it is formally resolved by replatting. City Administrator should contact builder with completed documents. Keith Gilbreath addressed Thistle Creek road damage,repair,and drainage. New concrete channel to handle flow will double estimated cost. He noted that budgeted water costs will increase by 39%in the next calendar year. The party interested in moving the Trotti house asked for 60-90 days. Tree is threatening fire hydrant in Thistle Creek,removal will cost$550. .f XVII. COMMENTS BY MAYOR None XVIII.
