Min P&Z 5/18/2010"CRY OF CHOICE" PLANNING AND ZONING MEETING 200 S. Main, Cibolo, Texas 78108 May 18, 2010 6:30 P.M. A possible quorum of the City Council may attend the Planning and Zoning meeting. Call to Order. Louis Chatman called the meeting to order at 6:33pm. 2. Roll Call. City Secretary Mark Winn, Mayor Pro -Tem Tony Krasnai, Councilman Dick Hetzel, Councihnan 3. Moment of Silence. 4. Pledge of Allegiance. 5. Citizens to be Heard: This is the opportunity for visitors and guests to address the Planning and Zoning Commission on any issue. Planning and Zoning Commission may not debate any non -agenda issue, nor may any action be taken on any non -agenda issue at this time however the Planning and Zoning Commission may present any factual response to items brought up by citizens. (Attorney General Opinion — JC 0169) (Limit of three minutes each). None at this time 6. Approval/Disapproval of the minutes from April 20, 2010 meeting. Josh Welch made a motion to approve the minutes from April 20, 2010 meeting. Norma Mashburn seconded the motion. All in favor none opposed. Motion passed 6-0. Public Hearing - (2010-003) Hold a Public Hearing and make a recommendation to City Council to zone 1.000± acres of land from no zoning to Commercial Light (C-1). The tract is situated in the James Jones Survey, Abstract No. 194, in the City of Cibolo, Guadalupe County, Texas, and is generally located on the northeast comer of Cibolo Valley Drive and Green Valley Road. Owner: Henry Alves Diana Weimer, 136 Running Brook, wanted to know why it was two separate issues. She is not opposed to the zoning change to Item #7. Henry Alves addressed the Planning and Zoning Commission about having 1.00Oacre zoned from a no -zoning classification to Commercial Light (C-1). Norma Mashburn made a motion to make a recommendation to City Council to approve the request of 1.000 acre from no -zoned to Commercial Light (C-1). Garth Coursen seconded the motion. All in favor none opposed. Motion passed 6-0. 8. Public Hearing — (2010-004) Hold a Public Hearing and make a recommendation to City Council to zone 4.010± acres of land from no zoning to Condo/Townhouse (R-5). The tract is situated in the James Jones Survey, Abstract No. 194, in the City of Cibolo, Guadalupe County, Texas, and is generally located on the northeast comer of Cibolo Valley Drive and Green Valley Road. Owner: Henry Alves Henry Alves stated he consulted staff on the remaining 4.010 acres of land that must be zoned at this time. The land has no zoning currently, and Henry Alves is requesting an R-5 zoning. Diana Weimer, 136 Running Brook, is opposed to the R-5 zoning request. If the zoning is approved, feels the potential 150 units of townhomes/condos would be a significant impact on the current resources. Ken Paciocco, 140 Running Brook, is opposed to the change in zoning. Henry Alves stated he had no choice He stated the City Staff chose this classification. Randal Anderson stated the applicant did not have to do this. Staff had to deal with 5 acres of land, had wide latitude to classify his property. Garth Coursen asked if owner was to develop, must have plat? Randall Anderson explained, when ready to develop, land must be platted. Maggie Patterson stated, as is, owner does not have to plat with metes and bounds. Henry Alves stated, does not want to plat this 4.010 acres. Norma Mashburn asked if the Commission should reconsider a lower residential classification, recommended an R-3, Single family, medium density. Robert Stricker stated an R-5 zoning, the owner keep what he wants, without the platting process. Scottland Roddy made a motion to recommend to City Council to zone 4.010 acres of land from no zoning to R-5 zoning. Josh Welch seconded the motion. In favor: Scottland Roddy and Josh Welch. Opposed: Garth Coursen, Norma Mashburn, and Louis Chatman and Sheldon Edmondson. Motion failed 2 to 4. Garth Coursen made a motion to recommend to City Council to zone 4.010 acres of land from no zoning to R-3 zoning. Norma Mashburn seconded the motion. In favor: Garth Coursen, Norma Mashburn, Louis Chatman and Sheldon Edmondson. Opposed: Scottland Roddy and Josh Welch. Motion passed 4 to 2. Discussion/Action/Recommendation to the City Council on the final plat approval of Cibolo Valley Ranch Unit 8. Al Guillen, 232 Anvil Place, asked if the drainage plans for Cibolo Valley Ranch Unit 8 had been thoroughly studied. Robert Stricker stated Espey Consulting and Klein Engineering have both looked over the drainage plans. Josh Welch made a motion to recommend to City Council to approve the final plat approval of Cibolo Valley Ranch Unit 8. Norma Mashburn seconded the motion. All in favor none opposed. Motion passed 6 to 0. 10. Item for future agendas. Randal Anderson asked Planning and Zoning Commission to consider a Special Planning and Zoning meeting on Junel, 2010 to consider a deferral request on the Tree and Landscape Ordinance. Louis Chatman informed the Commission that he would be having knee surgery and will miss approximately 2-3 meetings. 11. Adjournment Josh Welch made a motion to adjourn the meeting.
