Ord 1393 02/14/2023 Committee Resid Requirementr< rex A`' "City of Choice" ORDINANCE NO. / 3 5/3 AN ORDINANCE OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS, AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE IV, BOARDS AND COMMISSIONS, DIVISION 7, OATH OF OFFICE, SECTION 2-282, PROOF OF' RESIDENCY, OF THE CODE OF ORDINANCES BY REQUIREING PROOF OF RESIDENCY FOR ALL MEMBERS OF COMMISSIONS, COMMITTEES, BOARDS, & CORPORATIONS, AUTHORIZING THE CITY SECRETARY TO TAKE ALL NECESSARY STEPS TO IMPLEMENT THE PROVISIONS OF THIS ORDINANCE; INCORPORATING RECITALS; PROVIDING FOR SEVERABILITY; REPEALING ANY OTHER CODE PROVISIONS, ORDINANCES, OR PARTS OF ORDINANCES, AND OTHER PROVISIONS IN CONFLICT HEREWITH; AND SETTING AN EFFECTIVE DATE. WHEREAS, The City of Cibolo is a Home. Rule Municipality located in Guadalupe County, Texas, created in accordance with provisions of the Texas Local Government Code and operating pursuant to its adopted City Charter and all applicable. laws and enabling legislation of the State of Texas; and WHEREAS, The City of Cibolo City Charter establishes the authority and procedures for City Council to create, establish or appoint such boards, committees, or commissions it deems necessary to carry out the functions and obligation of the City; and WHEREAS, The City of Cibolo requires its members of boards, commissions, or committees to be residents .of the City because the City desires to involve its citizens that will really function as a third party, stakeholder group; and WHEREAS, The City of Cibolo City Council to ensure that appointees are residents of the City, will require documentation for that purpose. NOW, THEREFORE BE IT RESOLVED AND ORDERED. BY THE CITY COUNCIL OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS: -SECTION 1. AMENDMENT. That the City of Cibolo Code of Ordinances, Chapter 2, Administration, Article IV; Boards and Commissions; Division 7, Oath of Office, Section 2-282, Proof of Residence be added and is hereby amended to read as. follows: DIVISION 7. — OATH OF OFFICE AND.PROOF OF RESIDENCY Sec. 2-282.- Proof of Residency (a) Members currently serving on one of the City of Cibolo's Committees, Commissions, Boards and Corporation are required to provide to the City Secretary a copy of a City of Cibolo Electric Bill, City or Green Valley Water Bill, a City Gas Bill, or any other. notarized _document the City: Secretary accepts which .substantiates residency. The document presented should show the name of the candidate, the candidate's spouse, the candidate's landlord or the candidate's parent showing that they have lived in the City of Cibolo for one year. Such documents shall be reviewed, filed and maintained by the City Secretary. (b) All individuals. in the future that apply to _ serve on_a Committee, Commission, Board, or Corporation that -require residency will provide in their name a copy of the following document at the.time they submit their application showing they have lived in the City of Cibolo for at least one year. i. Copy of a City of Cibolo or Green Valley,Water Bill ii. Copy of an. Electric Bill iii. Copy of a Gas Bill; or iv. Any notarized document the City Secretary accepts . -(c) An applicant may provide a document required in Section (a) or (b) in the name of their spouse, parent or landlord and the acceptance ' of such= - document will be at the discretion of the City. Secretary. SECTION 2. Upon approval of this Ordinance by the City Council, Members currently serving on one of the City of Cibolo's Committees, Commissions, Boards and Corporation'shall have sixty- (60) days to provide the required documentation to the City Secretary. SECTION -3. The remainder of Chapter 2, Article IV, Division 7 of the City Code of Ordinances not amended by this Ordinance remains unchanged. SECTION 4. FINDINGS. The City Council finds all of the above recitals to be true and correct and incorporates the same in this Ordinance as findings of fact. SECTION 5. SEVERABILITY CLAUSE: If any section, . subsection, phrase, sentence,. or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent. jurisdiction, such portion shall be stricken from the ordinance, and such holding shall not affect the validity of the remaining portions thereof. The 2 balance: of the ordinance shall be construed as one instrument and as if the offending portion -had not been included. SECTION 6. SAVINGS CLAUSE: All ordinances or parts of ordinances, in conflict herewith are to _'the extent of such conflict hereby repealed-.' The balance of such ordinance is hereby saved from repeal. SECTION 7. EFFECTIVE DATE. This Ordinance shall be effective immediately upon approval by the City Council. APPROVED AND ADOPTED on this the 14th day of February, 2022.
